It is the purpose of this chapter to preserve the public peace and good
order, to prevent riots and tumultuous assemblages, unreasonably loud or disturbing
noises and disorderly, noisy, riotous or tumultuous conduct; and to promote
the health, safety, morals and general welfare of the community, consonant
with the rights of its citizens and inhabitants and others in the Town of
Warwick to peacefully assemble. It is a further purpose of this chapter to
provide for the regulation and licensing of public entertainment as defined
herein.

This chapter shall regulate the assembly of persons at
temporary outdoor public gatherings, whether for entertainment or the use
of premises such as for, but not limited to, the harvesting of fruits or crops
and the incidental use of such premises for picnicking, excursions and other
related activities, whether in concert or individually, where 250 or more
persons are expected to congregate in the Town of Warwick.

So far as requirements for written permits are concerned,
this chapter shall not be construed to apply to religious services, church
socials, political rallies, barbecues or outdoor meals sponsored by eleemosynary
or nonprofit organizations, circuses, carnivals, amusement parks or rides
for hire. However, no person shall conduct or take part in a carnival, sideshow,
menagerie, circus, exhibition or show in the Town of Warwick, outside of any
incorporated village in said Town, held outside of a regular theater, auditorium
or opera house and either within the public highways or upon private property,
without first obtaining a license therefor as hereinafter provided.
Unless otherwise expressly stated, the following terms shall, for the
purposes of this chapter, have the meanings herein indicated:
The gathering, collecting or congregating of persons with or without
the levy of an admission fee.
A structure wholly or partially enclosed within exterior walls and
a roof, of permanent or temporary nature, affording shelter to persons, animals
or property.
Written authority issued upon proper written application and payment
of a required fee, to conduct public entertainment as defined herein in the
Town of Warwick.
Written authority, issued upon proper written application and payment
of a required fee, to conduct a temporary outdoor public gathering as defined
herein within the Town of Warwick.
Includes but is not limited to carnivals, sideshows, menageries,
circuses, exhibitions or shows held outside of a regular theater, auditorium
or opera house.
A place to which the public or a substantial group of persons is
invited or has access.
A construction that is safe and stable and includes, among other
things, tents, stadiums, amphitheaters and other similar facilities.
The gathering of persons on public or private property as described in § 115-2 for less than 30 days in the case of entertainment or seasonally where the number of persons to gather shall normally occur in surges on weekends and holidays.
