A not-for-profit regional Cable TV Public Access Committee may be formed consisting of representatives from the Village of Westfield, Town of Westfield, Village of Mayville, Town of Chautauqua, Town of Ripley and Town of Portland.

Each municipality's representation shall be entitled to one vote, and appointments to this Joint Public Access Committee shall be on the recommendation of the existing Cable TV Advisory Committee upon approval of the Town Board.
The formation of this not-for-profit committee will facilitate the obtaining of a waiver to secure a franchise fee of a percentage as decided upon by the town, will aid in the obtaining of grants and will allow the securing of funds from each municipality, by contract with the Public Access Committee, for a portion of the franchise fee.

The Town of Westfield does hereby authorize its members on said committee, in conjunction with the members of the other five franchise municipalities, to incorporate said committee as a not-for-profit corporation under the laws of the State of New York.
The present members of said committee, appointed by the franchise municipalities, shall constitute the initial Board of Directors of said not-for-profit corporation, and that future members of the Board shall be appointed, at intervals to be designated in the bylaws of said not-for-profit corporation, by the franchise municipalities, and shall consist of two directors from each franchise municipality.
The membership of said not-for-profit corporation shall consist of all subscribers to US Cable of Westfield, Mayville, Chautauqua, Ripley and Portland within the franchise municipalities who make application for membership and who comply with all conditions of active membership as may be prescribed by the Board of Directors of said not-for-profit corporation.
Said not-for-profit corporation shall have all the powers and authorities delegated to it by the Town Board of the Town of Westfield in said town's resolution made the 7th day of September, 1988, creating said access committee, and that said not-for-profit corporation shall be the sole entity responsible for all matters involving cable public access within the franchise municipalities and shall enforce all provisions, with respect to cable public access, of the franchise agreements pertaining to the franchise municipalities.
Said not-for-profit corporation shall receive a franchise fee of a percentage, as decided upon by the town, received by the Town of Westfield from US Cable, its successors or assigns, under said franchise agreements.

The Town Board of the Town of Westfield will review the above percentage figures annually.
