This article applies to factory-manufactured homes, mobile homes, modular homes, double-wide homes and travel trailers. This chapter shall be enforced by the Town of Westfield Code Enforcement Officer.
For the purpose of enforcement of this chapter only, each mobile home or double-wide home or modular home that is brought into the Town of Westfield for the purpose of occupancy and not being placed within a preexisting and established mobile home park will be considered a "building" being erected in the Town of Westfield and subject to all administration and enforcement procedures established Chapter 185, Zoning, of the Code of the Town of Westfield and the New York State Uniform Fire Prevention and Building Code.
Any person who commits or permits any acts in violation of any of the provisions of this chapter shall be deemed to have committed an offense against such chapter and shall be liable for the penalty herein provided. Each day any violation shall continue or be permitted to exist shall constitute a separate additional violation.
A. 
For every offense or violation of any provision of this chapter, the person violating the same or committing the offense shall be liable for a fine of not more than $1,000 or imprisonment not to exceed one year, or both such fine and imprisonment.

B. 
Action or proceeding; civil penalties.
(1) 
The Town Board may also maintain an action or proceeding in the name of the town in a court of competent jurisdiction to compel compliance with or to restrain by injunction any violation of this chapter.
(2) 
In addition to or apart from any action or proceeding to enjoin any violation, the person violating any provision of this chapter shall be liable for a civil penalty or liquidated damages up to $100 per day for each day such violation continues after such person has received notice by certified mail to cease, discontinue or remove the violation.[2]

C. 
The Code Enforcement Officer or his designee or his duly authorized Deputy Code Enforcement Officer, pursuant to Municipal Home Rule Law, shall have the authority to issue appearance tickets for the violation of any provision of this chapter.
