A. A Planning Board consisting of five members shall
be appointed and shall exist and serve as specified in § 7-718
of the New York State Village Law and all other applicable provisions
of the Village Law.
B. Alternate Planning Board members may be appointed
by the Village Board to serve in the place of a regular Planning Board
member in those instances where it is difficult for the Planning Board
to maintain a quorum because a regular Planning Board member is ill,
on extended vacation, or has a conflict of interest situation on a
specific matter before such Board. In such instances, official business
cannot be conducted which may delay or impede adherence to required
time lines. The use of alternate Planning Board members in such instances
is hereby authorized.
(1) The number of alternate Planning Board members shall
not exceed two.
(2) All provisions of New York State law relating to Planning
Board member eligibility, vacancy in office, removal, compatibility
of office, service on other boards, as well as any provisions of any
local law relating to training, continuous education and attendance,
shall apply to alternate members of the Planning Board.
The Planning Board shall have the following
duties with respect to this chapter:
A. Recommendations.
(1) Optional reports. The Planning Board shall submit
reports within 30 days after referral on any matter referred to it.
(2) Mandatory recommendations. The Planning Board shall
submit recommendations to the appropriate Board on all applications
for:
(a)
Cluster residential development.
(c)
Subdivisions, including all supporting materials.
(d)
Site plan review, providing recommendations
for approval or for disapproval as required by this chapter.
(e)
Mining permits, all supporting materials and
reuse plan.
(g)
All zoning issues uses for which referral to
the Planning Board is mandatory.
(3) Delegation. By delegation of the Planning Board, an
individual member may make investigations into specific matters currently
before the Planning Board, provided that they do not overlap or infringe
upon the duties of the Zoning Officer.
(4) Failure to report. When the Planning Board fails to
make a recommendation/report within 30 days from receipt of the request,
it shall be deemed that the Planning Board has no opinion on the proposal.
The thirty-day requirement may be extended with the permission of
the Board making the referral.
B. Special use permits. To issue or deny special use
permits after a public hearing for any of the uses for which this
chapter requires the obtaining of such permits.
C. Architectural plan review. To issue or deny architectural plan approval
for any of the uses for which this chapter requires architectural
plan review.

D. Review. To review this chapter at least every five
years and make written recommendations for amendments, should it be
necessary.
E. Regulation. The Planning Board is responsible for
developing, updating and administering the Village subdivision regulations.
