The Borough, after considering the relative principals under the Pennsylvania
Emergency Medical Services Act, 35 P.S. § 6921, et seq. and the
authority of a municipality to make the designation of a primary provider,
has decided that it is in the best interests of the residents and visitors
of the Borough of Kutztown, in order to prevent premature death and to reduce
suffering and disability that may arise from a critical illness or injury,
to designate a primary ambulance provider within the Borough of Kutztown.
It is the intent of the Borough of Kutztown, through the designation of a
primary provider for the Borough, to provide the Borough with an effective,
efficient and reliable emergency medical services system, including basic
and advanced life support emergency medical care and 911 services, that are
equally accessible in a timely fashion to residents and visitors of the Borough.
The Borough of Kutztown may appoint, by a duly authorized resolution
of the Borough of Kutztown Borough Council, an advanced life support ambulance
service, licensed by the Pennsylvania Department of Health, to be the primary
provider of emergency medical ambulance services for the Borough of Kutztown.
Furthermore, the designated primary provider shall remain the primary provider
of emergency medical ambulance services for the Borough of Kutztown until
such time as either it notifies the Borough of Kutztown that it no longer
desires the designation or the designated primary provider is unable to provide
the services of a primary provider of emergency medical ambulance services
to the Borough of Kutztown or the Borough of Kutztown designates another emergency
medical ambulance service as the primary provider for the Borough of Kutztown
by the adoption of a resolution designating another emergency medical ambulance
service as the primary provider for the Borough of Kutztown.
It shall be the responsibility of the primary provider of emergency
medical ambulance services for the Borough of Kutztown to be the first-due
EMS responder for all emergencies requiring basic and/or advanced life support
care, treatment or transportation in the Borough of Kutztown.
The Borough of Kutztown hereby directs the Berks County Communication
Center to dispatch the designated primary provider as the first-due provider
for all emergencies within the Borough limits of the Borough of Kutztown.
In the event that the primary provider is unavailable for any reason
for calls within the Borough of Kutztown, the next closest available BLS and/or
ALS ambulance service should be in place of the primary provider for the Borough
of Kutztown.
