The administrative office of Lake City Borough Code Enforcement Officer
(hereinafter "Code Enforcement Officer") is hereby created.
The office of Code Enforcement Officer shall be filled by appointment
by a majority vote of the Lake City Borough Council, and the compensation,
if any, to be paid to the Code Enforcement Officer shall be determined by
an appropriate resolution of Lake City Borough Council.
The Code Enforcement Officer shall be authorized to investigate and
enforce violations of all ordinances of Lake City Borough.
Upon finding reasonable cause to believe that a violation of an ordinance
is occurring or has occurred, the Code Enforcement Officer shall:
A. Notify, in writing, the Mayor of Lake City Borough and
the Police Chief of Lake City Borough of the nature of the suspected violation
and the name of the suspected violator or violators.
B. After providing said written notification to the Mayor
and Police Chief, the Code Enforcement Officer shall proceed with the enforcement
of each said ordinance and shall follow the procedures and standards for ordinance
enforcement set forth in each specific ordinance, and as is required by law.
Notwithstanding any provisions set forth within this chapter, the authority
to enforce any ordinance of Lake City Borough granted to the Code Enforcement
Officer shall be deemed to be nonexclusive and shall be shared with the Lake
City Borough Police Department, and the Lake City Borough Police Department
shall specifically retain the power to execute and enforce all laws and ordinances
of the Borough of Lake City and investigate all violations thereof.
