Any person who violates any provision of this
Part 2 shall be guilty of summary offense and, upon conviction, shall
be required to pay a penalty for the use of the Borough of Lake City
in a sum not less than $5 nor more than $500, together with the costs
of prosecution, and in default of such payment, shall be imprisoned
in county prison for a term not to exceed 30 days.
Upon repeated violation by the same permittee, his right to the issuance of a permit or to continued operation under a permit may be suspended for a fixed term or permanently revoked after notice and hearing by the Zoning Hearing Board, subject to the right of appeal to the Erie County Common Pleas Court in accordance with Article X, Sections 1001 through 1011 of the Pennsylvania Municipalities Planning Code.[1]
