A.
The Board of Supervisors herein establishes the Lower Makefield Township Land Trust which said Trust shall be administered by the Board of Supervisors.
B.
The purposes of the Trust shall be as follows:
(1)
The acquisition and preservation of historic sites and structures.
(2)
The acquisition and preservation of open space.
(3)
The protection of environmentally sensitive lands.
(4)
The acquisition and preservation of active and passive recreation sites.
(5)
The maintenance and upkeep of properties acquired pursuant to the aforementioned purposes of this section including administrative expenses.
C.
Any funds received by the Lower Makefield Township Land Trust shall be utilized for the purposes as set forth in Subsection B of this Article.
D.
In furtherance of the desire of the township to raise money through donations, the township is authorized to advertise and to solicit donations which said expenses shall be drawn from the Land Trust and not from general township revenues. The township is further authorized to advise potential donors that their contributions would be charitable donations pursuant to the appropriate Internal Revenue Service Regulations. In addition, the Township Board of Supervisors may receive funds that are earmarked for a specific project, and the Board of Supervisors shall segregate those funds for a period of five (5) years in order to determine if the purpose of the funds can be achieved within the five (5) year period. If, at the end of the five (5) year period, the Board of Supervisors shall determine that the funds cannot be utilized for the purpose intended because of the lack of sufficient funds or for any other reason, then the funds may be integrated with other funds received pursuant to this Article and utilized for any other purpose as set forth herein.
E.
If the Lower Makefield Township Land Trust receives funds but it becomes apparent to the Board of Supervisors that sufficient funds will not be received by the Trust to effectuate any of the enumerated purposes, then the Board of Supervisors is authorized, after a public hearing, to utilize said funds together with other township revenues for any other purposes as set forth herein without the necessity of segregating Land Trust funds from general township revenues. Thereafter, the township will no longer solicit or receive any contributions to the Land Trust and this Article shall be null and void.
F.
The Board of Supervisors are not required to accept any donation and may refuse a donation for any reason.
