A. 
Words and phrases, when used in this chapter, shall have the meanings ascribed to them in the Vehicle Code of Pennsylvania (75 Pa.C.S.A. § 101 et seq.), as now in force, or as hereafter amended, enacted or reenacted, except where the context clearly indicates a different meaning. In this chapter, the word "street" may be used interchangeably with the word "highway" and shall have the same meaning as the word "highway" as defined in the Vehicle Code.
B. 
The term "legal holidays" as used in this chapter shall mean and include: New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and Christmas.
C. 
The term "day" as used in this chapter shall be defined as a calendar day.
D. 
In this chapter, the singular shall include the plural, the plural shall include the singular, and the masculine shall include the feminine and the neuter.
A. 
The Mayor and/or the Police Department shall have the following powers to regulate traffic and parking temporarily and in time of emergency:
(1) 
In the case of fire, flood, storm or other emergency, to establish temporary traffic and/or parking regulations.
(2) 
In the case of emergency or to facilitate public works or in the conduct of parades, processions or public events, to restrict or prohibit traffic and/or parking in limited areas for periods of not more than 72 hours.
B. 
Such temporary and emergency regulations shall be enforced by the Mayor and the Police Department in the same manner as permanent regulations. Any person who shall operate or park any vehicle in violation of any such regulation or who shall move, remove, destroy, injure, or deface any sign or marking erected, posted or made to give notice of any such regulations shall, upon conviction thereof, be liable to the penalty set forth in the law or elsewhere in this chapter for a violation of such nature.
A. 
The Borough Council may, from time to time, designate places upon and along the highways in the Borough where, for a period of not more than 90 days, specific traffic and/or parking regulations, prohibitions and restrictions shall be in force and effect and shall designate such locations by proper signs and markings. Such regulations, prohibitions and restrictions shall be effective just as if they had been specified in this chapter. No person shall operate or park a vehicle or tractor in violation of any such regulation, prohibition or restriction, and no person shall move, remove, destroy or deface any sign or marking erected, posted or made by authority of this section. Any person who shall violate any provision of this section shall, upon conviction thereof, be liable to the penalty set forth in the law or elsewhere in this chapter for a violation of such nature.
B. 
The purpose of this section is to allow for the test and experimental determination of the feasibility and desirability of permanent changes in the ordinances of the Borough relative to traffic and parking.

This chapter shall be enforced by the Chief of Police and the police officers of the Borough of Malvern, who are hereby given authority to direct traffic on the highways and intersections of the Borough in accordance with the provisions of this chapter and the laws of the Commonwealth of Pennsylvania; and also hereby given authority to enforce the regulation of parking of vehicles as described in this chapter.
Every person who shall ride a bicycle in any street, sidewalk, or other public place within the Borough shall do so with due care and pursuant to the regulations of the Pennsylvania Motor Vehicle as it is applicable to bicycles (see 75 Pa.C.S.A. § 3501). Bicycles may be ridden on Borough sidewalks. However, pedestrians are given the right-of-way on sidewalks at all times. Any person who shall violate any provision of this section shall, upon conviction thereof, for each and every violation, pay a fine of not more than $600 and the costs of prosecution thereof, which shall include reasonable attorney's fees.
A. 
It shall be unlawful to operate a skateboard upon any Borough highway, street, sidewalk or alley in a dangerous or reckless manner so as to endanger the property or physical safety of any person.
B. 
Unlawful and/or hazardous use shall include but shall not be limited to the following:
(1) 
Not yielding to pedestrians, bicycles or motor vehicles.
(2) 
Skateboarding on the following roadways: King Street, Bridge Street and Warren Avenue. These roadways are collector roads heavily utilized by pedestrians.
(3) 
Skateboarding from a driveway (public or private) onto a public thoroughfare. The risk of collision with a motor vehicle is unreasonably high if such practice is permitted.
(4) 
Skateboarding from one street onto an intersecting street without making a complete stop, whether or not a stop sign installed for vehicular traffic is in place. A child on a skateboard is not easily seen by vehicular traffic approaching perpendicularly.
C. 
The Police Department of the Borough of Malvern is charged with the responsibility of enforcing this chapter. Upon visual observation of a violation of this chapter, a police officer may cause the discontinuance of the skateboard riding, and any person who shall violate this chapter shall, upon conviction thereof, for each and every such violation, pay a fine of not more than $600 and the costs of prosecution thereof, which shall include reasonable attorney's fees.
A. 
Definitions. As used in this article, the following terms shall have the meanings indicated:
ALL-TERRAIN VEHICLE (ATV)
A small, open motor vehicle having one seat and three or more wheels fitted with large tires. It is designed chiefly for recreational use over roadless, rugged terrain.
MOTOR SCOOTERS
A two-tandem-wheeled (one in front of the other) vehicle, powered by gas engine, electric motor or any other power source, which may or may not have a seat or saddle for the driver. Motor scooters may include minibikes, small motorcycles, as well as motorized standing scooters.
B. 
It shall be unlawful for any person to operate motor vehicles, including motor scooters, motorcycles, all-terrain vehicles, and snowmobiles on any Borough-owned property or upon park and recreational areas leased, maintained or operated by the Borough except for areas that are improved with a paved surface and designated for such use.
C. 
Any person violating any of the provisions of this section, upon conviction thereof, for each and every such violation, shall pay a fine of not more than $600 and the costs of prosecution thereof, which shall include reasonable attorney's fees and shall be liable for the costs of restoration of property damaged.
