There is hereby established in the Village of Geneseo, Livingston County, New York, a scale of rents to be called "sewer rents," the revenues from which shall be used for the payment of the cost of management, maintenance, operation and repair of the sanitary sewer system, including treatment and disposal works, and, in the event of any surplus thereafter, may also be used for the enlargement or replacement of the same and for the payment of the interest on any debt incurred for the construction of such sanitary sewer system, including sewage pumping, treatment and disposal works, and for retiring such debt.
A. 
The Village shall review at least biannually the wastewater contributions, total cost of operation and maintenance expenses that are included in the unit charge for sewer rent and revise the charge as needed to comply with Federal Regulation CFR 35.929-2(b)(1)-(3).
B. 
Persons responsible for discharges of toxic wastes into the sewer system shall pay all costs incurred by the Village to handle, treat and dispose of the wastes.
C. 
Village costs for the treatment of all extraneous flow shall be distributed among all users in accordance with Federal Regulation CFR 35.929-2(d)(1)-(2).
D. 
The operation and maintenance costs as determined by this Article and included in the unit sewer rent charge shall take precedence over any inconsistent agreements between the Village and users.

A. 
The sewer rent charged to each premises to which this article is applicable shall be based on the amount of water, in cubic feet, used at each premises as computed quarterly by the Village of Geneseo.
B. 
The owner of any residence, apartment, commercial, business or industrial property, including factories, manufacturing facilities, schools, churches, hotels, rooming houses, professional offices, places of public assemblage, lodges, clubs, and all other places of business where sewer facilities are available shall pay an annual sewer rent of $260 annually, payable quarterly, for each separate unit of occupancy located within such building for each 2,000 cubic feet (15,000 gallons) of water or fractional part thereof consumed in each separate unit of occupancy during the quarter.

C. 
The owner of any private residence or commercial establishment located outside of the Village of Geneseo boundaries shall pay an additional sewer rent for each unit, payable quarterly.
A. 
All sewer rents shall be payable in equal quarterly installments billed August 1, November 1, February 1 and May 1.

B. 
If such sewer rents are not paid by the last business day of the billing month, a penalty of 10% on the unpaid balance shall be added.

C. 
Such sewer rents shall constitute a lien upon the real property served by sewers and such a lien shall be prior and superior to every other lien or claim, the lien of an existing tax, water rent or local assessment.
A. 
All revenues imposed hereunder, together with all interest and penalties thereon, shall be kept in a separate fund to be known as the "Sewer Fund."
B. 
No expenditures chargeable against the Sewer Fund shall be incurred, except upon authority of the Board of Trustees and for a purpose for which such Sewer Fund has been established, as hereinbefore provided.
If bills are not paid within 20 days from date due, a notice will be sent to the user demanding payment within 10 days and advising that the sewer service and/or water service are subject to discontinuance, and after the expiration of the period specified in the notice, such sewer service and/or water service shall be subject to discontinuance without further notice.
A charge of $10 will be made for discontinuance or reconnection of such service on account of nonpayment of sewer rents, which charge or charges will be treated as sewer rents.
