It shall be unlawful for any person to canvass
or solicit from house to house or from person to person, in the Borough
of North Arlington, without first obtaining a license therefor from
the Chief of Police or other officer in charge of police headquarters,
as hereinafter provided.
Before the Chief of Police or other officer
in charge of police headquarters shall issue a license to canvass/solicit,
he/she shall be satisfied that the applicant has attained the age
of 18 years and, from an examination of the application or other further
investigation to be made at the discretion of such officer, has answered
the application truthfully and honestly, and the project for which
he/she is canvassing/soliciting is free from fraud. Said determination
shall be made within seven calendar days of the receipt of a fully
completed application.
If the Chief of Police or other officer in charge
of police headquarters is satisfied with the sufficiency of the application,
he/she shall issue a license upon forms to be furnished by the Borough
of North Arlington, signed by the issuing officer and containing the
following information concerning the applicant; the full name and
address, place and date of birth, height, weight, race and marital
status; the name and address of his/her employer; the nature or description
of the project for which he/she is canvassing/soliciting; the date
of issue; the date of expiration; the daily hours during which canvassing/soliciting
may be carried on; and the licensee's signature.
All licenses shall be placed in a transparent
license holder, to be furnished by the Borough and worn by the licensee
on the lapel or other appropriate place of the outer garment of his/her
wearing apparel at all times during which the licensee is engaged
in canvassing or soliciting. The license holder shall be furnished
by the Borough at a fee of $4, $2 of which shall be returned to the
licensee upon the expiration of the license, and the license holder
shall be returned to the Chief of Police or other officer in charge
of police headquarters.
No license shall be granted to canvass/solicit
between 9:00 p.m. and 9:00 a.m.
All licensees shall be courteous, conduct themselves
in a lawful manner and refrain from becoming an annoyance to persons
solicited.
No license holder shall canvass/solicit and/or
solicit or in any other manner approach a residence or other building
upon which residence or building a sign or other warning exists visibly
stating that canvassers and/or solicitors are not welcome or other
notice exists that can reasonably be interpreted to express the resident's
or occupant's objection to any canvasser and/or solicitor approaching
the residence or building.
Any person engaged in the delivery of goods,
wares, merchandise or other articles or things in the regular course
of business to the premises of persons either ordering or entitled
to receive the same shall be exempt from the operation and effect
of this article.
Any license granted hereunder may be revoked
or rescinded by the Chief of Police or other officer in charge of
police headquarters upon the failure of the licensee to comply with
the terms and provisions of this article, or if after the license
has been granted, the Chief of Police or other officer in charge of
police headquarters is satisfied that the licensee has violated this
article or he/she is canvassing for a fraudulent purpose.
Any person who shall violate a provision of this article or fail to comply therewith shall, for each and every such violation and noncompliance, forfeit and pay a penalty as provided in Chapter
1, Article
I, General Penalty.
