[HISTORY: Adopted by the Mayor and Council of the Borough of Oceanport 6-5-1975 by Ord. No. 370 (Ch. 2 of the 1970 Code). Amendments noted where applicable.]
The office of Municipal Administrator is hereby created in and for the Borough of Oceanport by and subject to the provisions of this chapter and in accordance with N.J.S.A. 40A:9-136 et seq., and the employment of a person to fill such office is hereby authorized.
The Municipal Administrator shall be appointed by the Mayor with the advice and consent of the Borough Council. In the event the Mayor fails to nominate such Municipal Administrator within 30 days after the office is created or after the office shall become vacant, or in the event the Council fails to confirm any nomination made by the Mayor, then, after the expiration of such 30 days, the Borough Council shall appoint the Municipal Administrator by a majority vote, the Mayor having no vote thereon except in case of a tie. The term of office of the Municipal Administrator shall be at the pleasure of the governing body. He shall be removed only by a two-thirds vote of the governing body. The resolution of removal shall become effective three months after its adoption by the governing body. The governing body may provide that the resolution shall have immediate effect; provided, however, that the governing body shall cause to be paid to the Administrator forthwith any unpaid balance of his salary and his salary for the next three calendar months following adoption of the resolution.
The Municipal Administrator shall receive such compensation as shall be fixed from time to time by the Borough Council in a Salary Ordinance.[1]

The Municipal Administrator shall perform the following duties:
A. 
Provide general supervision for the operation of sanitation services and maintenance of roads, drainage systems, Borough buildings and grounds, parks, playgrounds and vehicles.
B. 
Study and recommend to the Mayor and Council equipment acquisitions, facility construction or other measures which will improve the efficiency and effectiveness of sanitation services, roads, streetlighting, drainage, Borough buildings and grounds.
C. 
Study, recommend for approval by the Mayor and Council and supervise a coordinated system for the purchase of supplies, materials, equipment and contractual services for all departments, in accordance with all applicable statutes, sound purchasing practices and budget limitations; prepare or cause to be prepared specifications for bidding in consultation with other Borough officials involved and ensure compliance with specifications.
D. 
Function as a liaison between the Mayor and Council and the Planning Board, Tax Assessment Board, Board of Health, Welfare Board, Waterways Committee, Shade Tree Committee, Northeast Monmouth County Regional Sewerage Authority, Historical Society, Citizens Advisory Committee and the Economic Development Committee.[1]

E. 
Act as liaison with the Borough Engineer and with any other consultants retained for planning, zoning, engineering or architectural services and, when assigned by the Mayor and Council, with consultants retained for other types of services.
F. 
Collaborate with the Construction Official and Zoning Officer with regard to amendments and supervision of the zoning, building and property maintenance codes.[2]

G. 
For the areas of responsibility assigned by this chapter or by the Mayor and Council:
(1) 
Provide personnel administration, including negotiation of collective bargaining agreement.
(2) 
Prepare recommendations for applicable items in the capital and operating budgets.
(3) 
Study, recommend to the Mayor and Council and provide liaison for any county, state or federal services or grants for which the Borough may be eligible.
(4) 
Provide liaison with the Borough Attorney or other legal counsel engaged by the Borough.
H. 
Maintain effective communications with other Borough officials, including the Borough Clerk, Tax Collector-Treasurer, Chief of Police, Judge, Fire Chief, Fire Marshal and Tax Assessors, informing them about any actions which may affect their function and, if requested, providing any assistance which is feasible.
I. 
Carry out other administrative and managerial functions as may be assigned by the Mayor and Council consistent with the will of the governing body.
J. 
Provide administrative assistance to the members of the governing body in the implementation of its office duties, provided that requests for assistance by members of the governing body do not unreasonably interfere with the efficient administration of the office and staff of the Borough Administrator.
The Municipal Administrator shall be appointed on the basis of executive and administrative abilities, with special regard to education and/or training and experience related to the functions assigned to the said office in this chapter.
Notwithstanding the aforementioned duties of the Borough Administrator, the Mayor and Council may also appoint the Municipal Administrator to serve contemporaneously as Borough Clerk.
