There is hereby created in and for the borough a Shade Tree Advisory
Committee to be known as the Shade Tree Advisory Committee of the Borough
of Old Tappan.
The Shade Tree Advisory Committee shall make recommendations
to the Mayor and Council for the regulation, control, planting, care and preservation
of shade and ornamental trees and shrubbery along the right-of-way of all
streets and highways within the borough and upon all parks and public places,
except federal, state, or county parks.

A.
The Shade Tree Advisory Committee shall consist of five
members who shall be residents or full-time employees of the borough, one
of whom may be a member of the Planning Board. The members of the Advisory
Committee shall be appointed by the Mayor with approval of the Council for
five-year terms to serve without salary on a staggered basis.
B.
Any vacancy occurring for any reason shall be filled
for the unexpired term by appointment of the Mayor.
C.
The Shade Tree Advisory Committee shall organize annually
and from its members elect a Chairman, Vice Chairman and Secretary.
A.
The duties of the Shade Tree Advisory Committee shall be to make recommendations for the enforcement of the provisions of Chapter 218, Subdivision and Site Plan Review, concerning all forms of shade tree matters, to make recommendations for the enforcement of the provisions of Chapter 234, Trees, to inspect and recommend the designation of trees to be kept on major subdivisions and to advise the Mayor and Council on all matters concerning shade trees and the planting of shrubbery and trees on all public property and parks.
B.
The duties more specifically stated shall include but
not necessarily be limited to the following:
(1)
Before final release of other bonds guaranteeing the
planting of shade trees, the Advisory Committee shall recommend the designation
on each plot in the subdivision along the street right-of-way the location
of shade trees to be planted.
(2)
To make recommendations for the regulation and control
of the use of the ground surrounding such trees so far as may be necessary
for the proper growth and protection.
(3)
To make recommendations for the care of shade trees,
ornamental trees, shrubbery, including planting, trimming, and spraying, which
may hereafter be planted on any street right-of-way or upon any park of public
land.
C.
No member of the Advisory Committee shall act or take
part in any action which would benefit his or her person.
