[HISTORY: Adopted by the Mayor and Council of the Borough of Old Tappan 5-26-1975 as Ch. VII of the 1975 Code, as amended through Ord. No. 684-99. Subsequent amendments noted where applicable.]
As used in this chapter, words and phrases concerning traffic shall have the meanings ascribed to them in N.J.S.A. 39:1-1.
A. 
Regulations not exclusive. The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.
B. 
Parking prohibited during state of emergency.
(1) 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary emergency no parking signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, fires, public celebrations, etc., dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
(2) 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
(3) 
The effectiveness of this section is contingent upon signs being erected as required by law.
C. 
Parking prohibited at all times on certain streets. No person shall park a vehicle at any time upon any of the streets or parts of streets described in Schedule I attached to and made a part of this chapter.
D. 
Parking prohibited during certain hours during certain months. No person shall park a vehicle between the hours of 2:00 am. and 6:00 a.m., from November 15 to April 1 on any street or road in the Borough.
E. 
Parking during certain hours on certain days prohibited. No person shall park a vehicle at any time upon any of the streets or parts of streets between those hours specified in Schedule II attached to and made a part of this chapter.
F. 
One-hour parking during certain hours on certain days. No person shall park a vehicle for longer than one hour upon any of the streets or parts of streets between those hours specified in Schedule IIA attached to and made a part of this chapter.

G. 
Parking prohibited on certain property. No person, other than emergency personnel, including but not limited to Fire Department and first aid corps members, shall park a vehicle on property situated in easterly direction from the Old Tappan Fire House, along Russell Avenue, or on the first aid corps building property, known as Lot 2 in Block 1605, and Lot 3 in Block 1604, respectively, as shown on the current Tax Assessment Map of the Borough.
H. 
Restricted parking spaces.
(1) 
Signs; location. Pursuant to the provision of N.J.S.A. 39:4-197.5, restricted parking spaces for use by handicapped persons (as defined in N.J.S.A. 39:4-205) are hereby established, as described in Schedule VIII attached to and made a part of this chapter. Handicapped parking signs shall be installed adjacent to or on the surface of such parking spaces at the expense of the owner of the premises. If the premises have barrier-free entrances or other such facilities for the handicapped, such restricted parking spaces shall be located as near as possible to such barrier-free entrances of facilities. Otherwise, such restricted parking spaces shall be as near as possible to any public entrance to the premises.
(2) 
Restricted use. No person, other than a person who has been issued a handicapped person identification card by the Division of Motor Vehicles pursuant to the provisions of N.J.S.A. 39:4-205, and who is using a motor vehicle on which is displayed a placard or license plate bearing the national wheelchair symbol issued by the Director of the Division of Motor Vehicles pursuant to the provisions of N.J.S.A. 39:4-206, shall park in restricted parking spaces designated for handicapped persons.
(3) 
Unauthorized parking; penalty. Any person parking a motor vehicle in a restricted parking space as set forth in Schedule VIII, without having a placard or license plate bearing the national wheelchair symbol issued pursuant to N.J.S.A. 39:4-206, shall be liable to a penalty of not more than $100.

(4) 
Failure to maintain; penalty. Any owner, tenant or occupant of premises as set forth in Schedule VIII, who shall fail to install and maintain handicapped parking signs pursuant to Subsection H herein shall be subject to a penalty of not more than $250. Each day that the owner, tenant or occupant fails to satisfy the requirements of this subsection shall constitute a separate violation.
I. 
Parking prohibited in fire lanes. No person shall at any time park a motor vehicle or in any other manner obstruct any driveway or area that has been designated as a fire lane or zone pursuant to Chapter 131, Fire Prevention, § 131-6 of the Code of the Borough of Old Tappan.
J. 
Reserved parking spaces. No person other than the Mayor, the six members of Council, the Borough Clerk and the Tax Collector shall, at any time, park a motor vehicle or in any manner obstruct any parking space that has been designated as reserved for these municipal officials in the Borough Hall parking lot off Russell Avenue.
K. 
Parking permitted in yard areas under certain conditions.

(1) 
Other than with respect to planned residential developments, the parking of motor vehicles shall be permitted in residential zones or on property lawfully used for residential purposes only under the following conditions:
(a) 
Parking shall only be permitted in an enclosed garage or on any driveway or in a front yard area or side yard area as specified herein.
(b) 
Parking shall not be permitted in any rear yard area except in an enclosed garage or on any driveway.
(c) 
Parking in any front yard area or side yard area shall only be permitted, provided that:
[1] 
Said parking space or spaces within a permitted yard area are situated a minimum of 10 feet from any side lot line, and 10 feet from any front lot line, which front lot line shall be measured at the curb of the street on which the property fronts; and
[2] 
The surface for such parking space or spaces is constructed of impervious materials; and
[3] 
The percentage of impervious materials comprising any front yard area utilized for parking shall not exceed 25% of the total front yard area.
(d) 
Nothing contained herein is intended to preclude parking on driveways.
(2) 
The parking of motor vehicles shall be permitted in the B-1 Local Business District, the B-2 Office District, on property lawfully used for business, office or commercial purposes, or in a planned residential development only under the following conditions:
(a) 
Parking shall only be permitted in an enclosed garage, on any driveway, in a rear yard area, or in a front yard area or side yard area as specified herein.
(b) 
Parking in any front yard area or side yard area shall only be permitted, provided that:
[1] 
Said parking space or spaces within a permitted yard area are situated a minimum of 10 feet from any side lot line, and 10 feet from any front lot line, which front lot line shall be measured at the curb of the street on which the property fronts; and
[2] 
The surface for such parking space or spaces is constructed of impervious materials; and
[3] 
The size and location of such parking space or spaces have been approved by the Planning Board or Board of Adjustment, as the case may be, in connection with its review of a site plan application for said property.
(3) 
Notwithstanding anything contained herein, parking in a yard area other than as specifically limited herein shall be permitted, provided that a site plan design waiver has been granted by the Planning Board as the case may be.

L. 
Parking restricted at Oakes Park. No person, other than persons utilizing park facilities, shall park a vehicle in the parking lot at Oakes Park, located on Central Avenue, and shown as Block 1101, Lots 17 and 18, on the current Tax Assessment Map of the Borough.

A. 
Through streets. Pursuant to the provisions of N.J.S.A. 39:4-140, the streets or parts of streets described in Schedule III, attached to and made a part of this chapter, are hereby designated as through streets. STOP signs shall be installed on the near right side of each street intersecting the through street except where YIELD signs are provided for in the designations.
B. 
Stop intersections. Pursuant to the provisions of N.J.S.A. 39:4-140, the intersections described in Schedule IV, attached to and made a part of this chapter, are hereby designated as stop intersections. STOP signs shall be installed as provided therein.
C. 
Yield intersections. Pursuant to the provisions of N.J.S.A. 39:4-140, the intersections described in Schedule V, attached to and made a part of this chapter, are hereby designated as yield intersections. YIELD signs shall be installed as provided therein.
D. 
Prohibited turns. No person shall make the turns described in Schedule VI hereof attached and made a part of this chapter.

E. 
Speed limits. The streets or parts of streets described in Schedule VII, attached to and made a part of this chapter, shall have speed limits as set forth therein. Regulatory and warning signs shall be erected and maintained as required by the Division of Motor Vehicles.
F. 
Lane use restrictions. The streets or parts of streets described in Schedule IX, attached to and made a part of this chapter, shall have lane use restrictions as set forth herein.
G. 
Stopping or standing prohibited. No person shall stop or stand a vehicle at any time upon any of the streets or parts of streets described in Schedule X, attached hereto and by reference made a part hereof.
H. 
No turn on red. No person shall make a right turn upon a "Stop" or "Caution" signal at any of the locations described in Schedule XI, attached hereto and by reference made a part hereof.
I. 
Stopping or standing prohibited. No person shall stop or stand a vehicle upon any of the streets or parts of streets between those hours specified in Schedule XII, attached to and made a part of this chapter.

A. 
Applicability of state traffic regulations. The provisions of Subtitle 1, Title 39 of the Revised Statutes of New Jersey be and hereby are made applicable to the semipublic or private roads, streets, driveways, sidewalks, parking lots or other roadways open to or used by the public, tenants and employees for purposes of vehicular travel located on or within the Bi-State Plaza Shopping Center.
B. 
Parking. No operator of a vehicle in or upon the Bi-State Plaza Shopping Center shall stand or park such vehicle in other than a designated parking area and between painted lines as indicated on the site plan attached hereto and made a part hereof.
A. 
Applicability of state traffic regulations. The provisions of Subtitle 1, Title 39 of the Revised Statutes of New Jersey be and hereby are made applicable to the semipublic or private roads, streets, driveways, sidewalks, parking lots or other roadways open to or used by the public for purposes of vehicular travel located within the Lake View at Old Tappan development, shown as Lot 1 in Block 3000 on the Tax Map of the Borough of Old Tappan.
B. 
General parking.
(1) 
All vehicles must park in designated areas and between the lines provided.
(2) 
No person shall stop or stand a vehicle upon the entire length of Road "A," Road "B," Road "C," Road "D," or Lakeview Drive at any time. Road "A," Road "B," Road "C," and Road "D" and Lakeview Drive are as shown on the site plan for the Lakeview at Old Tappan development which is incorporated by reference herein and is available at the Borough Clerk's office in the Borough Hall.
(3) 
Handicapped parking. All stalls shall be signed with R7-8P (reserved parking sign and penalty plate) in the designated parking areas for persons who have been issued the handicapped parking permits by the Division of Motor Vehicles.
C. 
Stop intersections. The following described intersection is hereby designated as stop intersections. Stop signs shall be installed as provided herein:

Any vehicle parked or standing as to obstruct or impede a normal flow of traffic, block entrances or exitways, loading zones, oil fills, any grassy area, pedestrian walkway, or present in any way a safety or traffic hazard may be removed by towing the vehicle at the owner's or operator's expense.
G. 
Authorized vehicles only. No other vehicle than an authorized vehicle shall enter the fire access roadway.

Provisions of Title 39 applicable. The provisions of Subtitle 1 of Title 39 of the Revised Statutes of the State of New Jersey are applicable to the semipublic roads, streets, driveways and parking lots at the development known as The Village at Old Tappan.
B. 
General parking.
(1) 
All vehicles must park in designated areas and between the lines provided.
(2) 
Handicapped parking. All stalls shall be 12 feet wide as shown on the attached site plan[1] and signed with the R7-8 and R7-8P (reserved parking sign and penalty plate), in the designated parking areas for persons who have been issued the handicapped parking permits by the Division of Motor Vehicles.

G. 
All signs, posts or other necessary materials shall be installed and paid for by Winding Creek at Old Tappan Condominium Association or its successor in interest. All signing shall conform to the current Manual on Uniform Traffic Control Devices, pursuant to N.J.S.A. 39:4-198 and N.J.S.A. 39:4-183.27.
A. 
Installation and maintenance. The property owner, tenant or occupant of property shall be responsible for the installation and maintenance of any and all traffic control devices on his or her property at his or her own expense, including but not limited to signs and pavement markings.
B. 
Recommendations of Chief of Police. The Chief of Police may recommend to the Mayor and Council that a property owner, tenant or occupant install any traffic control device which is deemed necessary or in furtherance of the safe and efficient flow of traffic in accordance with this chapter and Title 39 of the New Jersey statutes.
C. 
Manual on Uniform Traffic Control Devices. All traffic control devices installed or maintained in accordance with this section shall conform to the Manual on Uniform Traffic Control Devices.

A. 
Designation of school crossings. In accordance with P.L. 1999, Ch. 185 (N.J.S.A. 2C:11-5 et seq.), the following is a list of school crossings which have been so designated by the Borough:
(1) 
Central Avenue and Haring Drive;
(2) 
Central Avenue and Northern Valley Regional High School;
(3) 
Old Tappan Road and Charles DeWolf School;
(4) 
Old Tappan Road and Washington Avenue;
(5) 
Washington Avenue and Herrick Drive;
(6) 
Charles Place and School Street;
(7) 
DeBerg Drive (behind T. Baldwin Demarest School);
(8) 
T. Baldwin Demarest School parking lot;
(9) 
Northern Valley Regional High School parking lot; and
(10) 
Charles DeWolf School parking lot.
B. 
Adoption of map. The Drunk-Driving-Free School Zones Map dated September 25, 2000, as prepared by Thomas W. Skrable, P.E., the Borough Engineer, is hereby approved and adopted as an official finding and record of the location and areas within the Borough of property which is used for school purposes and which is owned by or leased to any elementary or secondary school on school land and of the areas on or within 1,000 feet of such school property.[1]

C. 
Map and list to constitute official findings. The Drunk-Driving-Free School Zones Map approved and adopted pursuant to Subsection B of this section shall continue to constitute an official finding and record as to the location and boundaries of areas on or within 1,000 feet of property owned by or leased to any elementary or secondary school or school board which is used for school purposes until such time, if any, that this section shall be amended to reflect any additions or deletions with respect to the location and boundaries of school property and drunk-driving-free school zones. The list of school crossings designated above by the Borough continue to constitute an official finding and record of the location of school crossing zones within the Borough until such time, if any, that this section shall be amended to reflect any additions or deletions with respect to school crossing zones in the Borough.
D. 
Changes in locations or boundaries. The school board, or the chief administrative officer in the case of any private or parochial school, is hereby directed and shall have the continuing obligation to promptly notify the office of the Borough Engineer and the Borough Attorney of any changes or contemplated changes in the location and boundaries of any property owned by or leased to any elementary or secondary school or school board and which is used for school purposes or of any additions or deletions to school crossings.
E. 
Original map and list to be on file; copies. The Borough Clerk is hereby directed to receive and to keep on file the original of the map approved and adopted pursuant to Subsection B of this section and the list of school crossings and to provide at a reasonable cost a true copy thereof to any person, agency or court which may from time to time request such a copy, along with a certification that such copy is a true copy of the map approved and adopted herein and kept on file. It is hereby further directed that a true copy of such map and list and of this section shall be provided without cost to the Bergen County Clerk and to the office of the Bergen County Prosecutor.
F. 
Map and list as evidence. It is understood that the map and list approved and adopted pursuant to this section was prepared and is intended to be used as evidence in prosecutions arising under the criminal and traffic laws of this state and that, pursuant to state law, such map and list shall constitute prima facie evidence of the following:
(1) 
The location of elementary and secondary schools within the Borough.
(2) 
The boundaries of the real property which is owned by or leased to such schools or a school board.
(3) 
That such school property is and continues to be used for school purposes.
(4) 
The location and boundaries of areas which are on or within 1,000 feet of such school property.
(5) 
The location of all school crossings in the Borough.
A. 
General penalty. Unless another penalty is expressly provided herein or by statute, any person convicted of a violation of this chapter shall be liable to a penalty of not more than $100 or imprisonment for a term not exceeding 15, days or both. Each day that the person is in violation of this chapter shall constitute a separate violation.

B. 
Penalty for failure to maintain. Any person convicted of a violation of § 242-8 of this chapter shall be liable to a penalty of not more than $250 or imprisonment for a term not exceeding 15 days, or both. Each day the person is in violation of said section shall constitute a separate violation.

A. 
Whenever snow has fallen and the accumulation is such that it covers the roadway, an emergency shall exist and no vehicles shall be parked on any Borough street, road, highway, right-of-way or thoroughfare except in conformity with this section.
B. 
Except as permitted pursuant to this chapter, no vehicle shall be parked or left unattended on any street, right-of-way or thoroughfare, until the street, road, highway, right-of-way or thoroughfare has been plowed.
C. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.
D. 
Unless some other penalty is expressly provided by New Jersey statute, every person convicted of a violation of this section or any supplement thereto, shall be liable to a penalty of not more than $200.
