This article implements the provisions of P.L.
1991, c. 92, to require installation of at least one smoke detector
on each level of one- and two-family homes prior to the occurrence
of any sale, rental or change of occupancy. The Borough Fire Official
shall have the responsibility to enforce the provisions of this article.

A. Whenever there is a sale, rental or change of occupancy
of any building subject to the requirements of this article, no owner
shall sell, lease or otherwise permit occupancy for residential purpose
of that building without first obtaining from the Borough Fire Official
a certificate evidencing compliance with the requirements of the article.
B. If a change of occupancy does occur within six months,
a new application shall be required.
An owner who sells, leases, rents or otherwise
permits to be occupied for residential purposes any premises subject
to the provisions of this article when the premises do not comply
with the requirements of this article or without complying with the
inspection and certification requirements hereof shall be subject
to a fine of not more than $500, which may be collected and enforced
by the Borough Fire Prevention Bureau by summary proceedings pursuant
to the Penalty Enforcement Law, N.J.S.A. 2A:58-1 et seq., or any amendments
or supplements thereto.
