This article implements the provisions of P.L. 1991, c. 92, to require installation of at least one smoke detector on each level of one- and two-family homes prior to the occurrence of any sale, rental or change of occupancy. The Borough Fire Official shall have the responsibility to enforce the provisions of this article.
A. 
A structure used or intended for use for residential purposes by not more than two households shall have a smoke-sensitive alarm device, also known as a "smoke detector," on each level of the structure and outside each separate sleeping area in the immediate vicinity of the bedrooms and located on or near the ceiling or wall in accordance with National Fire Protection Association Standard No. 74-1984 for the installation, maintenance and use of household fire warning equipment. The installation of battery-operated smoke-sensitive alarm devices shall be accepted as meeting the requirements of this article; provided, however, that all smoke-sensitive devices installed pursuant to this article must be tested and listed by a product certification agency recognized by the Division of Fire Safety of the State of New Jersey.
B. 
Carbon monoxide alarms shall be installed in all dwelling units in buildings in Use Groups I-1, R-2, R-3 and R-4, except for units in buildings that do not contain a fueling-burning device or have an attached garage. Single station carbon monoxide alarms shall be installed and maintained in the immediate vicinity of the sleeping area(s). Carbon monoxide alarms may be battery-operated, hardwired or of the plug-in type and shall be listed and labeled in accordance with UL-2034 and shall be installed in accordance with the requirements of this section and NFPA-720.

A. 
Whenever there is a sale, rental or change of occupancy of any building subject to the requirements of this article, no owner shall sell, lease or otherwise permit occupancy for residential purpose of that building without first obtaining from the Borough Fire Official a certificate evidencing compliance with the requirements of the article.
B. 
If a change of occupancy does occur within six months, a new application shall be required.
A. 
A fee shall be paid to the Borough Fire Prevention Bureau to offset the cost of the inspection and certification required by this article. Said fee shall be in addition to any other fees required by other ordinances in connection with inspections and certifications by any other local, county or state agency.
B. 
The fee schedule shall be as follows:

(1) 
For requests received more than 10 business days prior to the sale, rental or change of occupant: $45.
(2) 
For requests received four to 10 business days prior to the sale, rental or change of occupant: $90.
(3) 
For requests received fewer than four business days prior to the sale, rental or change of occupant: $161.
C. 
The annual application fee for a carnival registration certificate shall be as follows:

For 10 or fewer locations: $77.
(2) 
For 11 to 25 locations: $116.
(3) 
For 26 or more locations: $155.
An owner who sells, leases, rents or otherwise permits to be occupied for residential purposes any premises subject to the provisions of this article when the premises do not comply with the requirements of this article or without complying with the inspection and certification requirements hereof shall be subject to a fine of not more than $500, which may be collected and enforced by the Borough Fire Prevention Bureau by summary proceedings pursuant to the Penalty Enforcement Law, N.J.S.A. 2A:58-1 et seq., or any amendments or supplements thereto.
