No person, corporation or other entity shall erect or maintain any basketball backstop or similar structure or portion thereof that may be used for recreational purposes in such a manner that the same extends upon or overhangs any street, alley or other public right-of-way in the Borough of Palmyra.
A. 
Any person, corporation or other entity violating any provision of this article shall be subject to a fine not exceeding $500 or imprisonment in the county jail not exceeding 90 days, or both, and that portion of any basketball backstop or similar structure overhanging any street, alley or any other public right-of-way may be removed by the Borough as constituting a public nuisance; provided, however, that before the Borough shall remove the same, the Borough shall give 90 days' written notice to the owner of the property on which the violation exists to remove the structure. If the owner fails to remove the violation within the 90 days, the Borough may remove the same and assess the cost of the removal against the owner in addition to the fine called for by this subsection.
B. 
A separate violation shall be deemed to be committed on each day during or on which a violation occurs or continues.
C. 
For violations of any of the provisions of this article, complaints may be filed by citizens, the police, the Zoning Officer and the Building Inspector.
