Editor's Note: The preamble to Ordinance No. 306 reads as follows:
"An Ordinance to control and Regulate the Conduct of the Forms of Sunday Recreation, Sports, and Amusements Made Lawful by Referendum Vote held November 8, 1949, in the Borough of Paulsboro, Gloucester County, New Jersey, and to Provide Penalties for the Violation of the Provisions of this Ordinance.
Whereas, a majority of the voters voting at the General Election held November 8, 1949, did vote in favor of the adoption Article 2, Chapter 201, Sections 18 to 28, inclusive, of the Revised Statutes of New Jersey; which article permits the following things to be done on Sunday:
A. Print, publish and sell newspapers;
B. Sell and deliver milk;
C. Walk, ride or drive for recreation;
D. Hire horses and carriages or other conveyances for riding and driving;
E. Engage or take part in any form of recreation, sport or amusement that is not unlawful on other days of the week, if in so doing such person or corporation does not disturb others in their observance of Sunday; and
Whereas, said article gives Council the power to adopt ordinances deemed necessary to control and regulate the conduct of the forms of recreation, sports or amusements made lawful on Sunday, and to control, regulate or restrict the commercialization of any such form of recreation, sports or amusement;
Therefore, be it ordained by the Mayor and Council of the Borough of Paulsboro, Gloucester County, New Jersey, as follows."
The following recreations, sports or amusements shall be permitted on Sunday:
It shall be lawful to charge and collect the same price, admission fees, game fees or rates on Sunday as are charged for the same recreation, sport or amusement on other days of the week. Prices or fees shall not be lower nor higher than those charged on weekdays.
Athletic events and sporting contests or games played out-of-doors shall be permitted between the hours of 1:30 p.m. and 12:00 midnight.
Athletic events and sporting contests or games played indoors shall be permitted between the hours of 1:30 p.m. and 12:00 midnight.
Moving pictures shall be permitted between the hours of 1:30 p.m. and 12:00 midnight.
Bowling, pool and billiards shall be permitted between the hours of 1:30 p.m. and 12:00 midnight.
Dancing shall be permitted between the hours of 1:30 p.m. and 12:00 midnight.
Any person, firm or corporation convicted of violating any of the provisions of this ordinance shall be liable to a fine not exceeding $50 or to imprisonment for a period not exceeding 30 days, or both, for a first offense; and shall be liable to a fine of $200 and imprisonment for a period not exceeding 90 days, or both, for a second offense; and if the business of the person, firm or corporation is one requiring the issuance of a Borough license, such license may be revoked or suspended as additional punishment, upon the conviction of a first or a second offense, in addition to any fine or prison term imposed by the Magistrate.
This ordinance shall take effect upon final passage and publication according to law, and Sunday recreation, sports or amusements shall not be permitted until that date.
