From time to time as hereafter determined and needed, and after consultation
with the Chief of Police, the Borough Council of Paulsboro may delineate by
resolution a zone or zones within the geographic boundaries of the Borough
to be known as "Zone(s) of Zero Tolerance for Drugs."
Such zones shall be narrowly tailored and clearly defined to include
only those areas of the Borough in which empirical evidence can show a disproportionately
high concentration of activity related to the possession, use, distribution,
dispensing, or manufacture of controlled dangerous substances, as that term
is defined at N.J.S.A. 2C:35-2.
B.Â
At the time of the aforementioned plea or conviction,
the defendant shall be given a map of the Borough showing all existing Zones
of Zero Tolerance for Drugs, which map shall be appended to and made a part
of a geographical restriction sentencing order in a form to be drafted by
the Borough Council and approved by the Municipal Court Judge serving the
Municipal Court of the Borough of Paulsboro.
C.Â
Any offender who has been served with a geographical
restriction sentencing order in accordance with this ordinance shall be guilty
of violating N.J.S.A. 2C:18-3(b) if he or she is found within a Zone of Zero
Tolerance for Drugs.
D.Â
In accordance with N.J.S.A. 2C:45-1(b)(6), such geographical
restriction sentencing orders, as aforementioned, may be used in the Municipal
Court of the Borough of Paulsboro at the discretion of the Municipal Court
Judge when any offender is sentenced to probation for any violation.
E.Â
The provisions of this ordinance may be suspended only
upon a showing of exceptional circumstances.
This ordinance shall take effect immediately upon passage in accordance
with applicable law.
