No person or persons, firm or corporation shall operate or maintain
any store, dwelling, establishment or stand of any kind for the sale or exposure
for sale of soft drinks or similar beverages, or shall conduct any store,
dwelling, establishment or stand for the sale or distribution of soft drinks
or similar beverages within the Borough of Paulsboro, without first obtaining
a license therefor, under and subject to the regulations herein.
Any person or persons, firm or corporation desiring to operate or maintain
any store, dwelling, establishment or stand of any kind for the sale or exposure
for sale of soft drinks or similar beverages shall first make application
in writing to the Mayor and Council of the Borough of Paulsboro for a license
for said purpose. Said application shall specify the place within said Borough
where said soft drink or similar beverage establishment is to be maintained,
the room or rooms to be used for said purpose and the character of the building
to be used in connection therewith, and in addition thereto said applicant
shall state his age and place of residence for the preceding five years, and
the name of the owner of the property to be used for said purpose. Said application
shall be filed with the Borough Clerk, together with the license fee hereinafter
mentioned. The Council of the Borough of Paulsboro shall have the sole right
and power to grant or reject any such application for such license, in its
discretion.
Every license issued hereunder shall be granted under and subject to
the following regulations, which by the acceptance of any such license, the
applicant therefor agrees to observe, and that a failure to observe the same
shall be construed as a violation of this ordinance, to wit:
A. That any license issued hereunder shall not be transferable
except after application duly made to the Council of the Borough of Paulsboro
in the same manner as the original application is made and the approval of
such transfer by the Council as aforesaid.
B. That the Council of the Borough of Paulsboro may at any
time for violation of these regulations or for a violation of any other provision
of this ordinance, after due notice to such licensee and public hearing before
said Council, revoke any license issued hereunder.
C. No person, firm or corporation other than the one intending
to maintain and operate such soft-drink or similar beverage establishment
shall make or cause to be made any application for a license hereunder.
D. That the making of any false statement in the application
herein referred to shall be construed to be a violation of the terms of the
ordinance, rendering the person making the same subject to the penalties herein
provided.
Every permit issued by the Mayor and Council hereunder shall be issued
on or after January 1 of each calendar year, and irrespective of the date
of issue, shall expire on December 31 of the calendar year of issue. Such
licenses may be renewed at the end of the calendar year for which issued upon
application being made as in the original application, but the license fee
prescribed in this ordinance shall be payable each year, said license fee
being hereby established to be an annual license fee.

The fee for the issuance of each license under the terms of this ordinance
shall be the sum of $3 per year.
Any person, firm or corporation violating any of the provisions of this
ordinance shall, upon conviction thereof before the Mayor or Municipal Court,
be subject to a fine of not more than $50 or imprisonment in the county jail
for a term of not exceeding 30 days, or both, in the discretion of the Mayor,
Borough Recorder or Justice of the Peace before whom said conviction may be
had.
Each day's persistence in the things or acts herein prohibited
shall be deemed and taken to be a separate and distinct offense, subject to
the penalties hereinabove provided.
The license fees herein provided for shall be imposed for the purpose
of regulation and revenue.
This ordinance shall take effect upon its proper passage and publication
as required by law.
