The Town Attorney shall be retained by the Mayor with the advice and consent of the Council for a term of one year with such compensation as may be determined by Council and which shall be within the limits of available appropriations.
The Town Attorney shall represent the Town in all legal matters and advise and assist the Mayor, the Council and the department heads as required in the administration of the Town government. He shall attend meetings of the Council, draft ordinances and resolutions and give opinions and ruling on questions of law which may arise at Council meetings. He shall prepare or approve all legal instruments relating to the business of the Town. He shall represent the Town in any litigation and conduct trials, appeals and other proceedings affecting the interest of the Town as he may in his discretion determine to be necessary or desirable, and as directed by the Mayor or Council.
The Town Attorney shall also:
A. 
Maintain records of all actions, suits, proceedings and matters which relate to the Town's interest, and report thereon from time to time as the Mayor or Council may require.
B. 
Have power to enter into any agreement, compromise or settlement of any litigation in which the Town is involved, subject to the approval of the Council.
C. 
Upon the termination of his service with the Town, forthwith surrender to his successor all Town property, papers and records, together with a written consent to substitution of his successor in any pending actions or proceedings.
Whenever he deems the interests of the Town so to require, the Town Attorney may, with the approval of the Mayor and Council within the limits of available appropriations, appoint special counsel to assist him in the preparation, trial or argument of any issue or in such other capacity as he may determine. If the Town Attorney should be disqualified with respect to any matter, the Mayor may appoint special counsel, with the approval of the Council, to represent the Town for and with respect to such matters.[1]
