§ 67-25.1 Schedule XA, Right Turn on Red Prohibitions.

In accordance with the provisions of § 67-13.1, no person shall make a right turn when facing a steady red signal (stop indication), whenever an official sign is present prohibiting such a turn on a red signal, at any of the following locations:

§ 67-28 Parking lots.

A. The gross vehicle weight (GVW) limit for any vehicle utilizing off-street parking lots under the jurisdiction of the Town shall be 10,000 pounds. For those off-street parking lots under the jurisdiction of the Town for which parking is permitted by permit only, the vehicle must have issued to it by the Town a permit to cover the hours of operation established by the Town.

B. Any vehicle parked in violation of this section without the proper permit or in violation of the weight restriction set forth in Subsection A above shall pay to the municipal court, either in person or by mail, the sum of $33 as a penalty for and in full satisfaction of such violation.

C. The owner or operator of any vehicle parked in violation of posted hourly parking regulations established pursuant to this section shall pay to the Court Administrator or Officer of the Court, either in person or by mail, the penalty established in accordance with the local Violations Bureau schedule.

D. Any person parked in an off-street parking lot under the jurisdiction of the Town and found making motor vehicle repairs, including changing of motor oils or fluids, shall pay to the Municipal Court, either in person or by mail, the sum of $68 as a penalty for and in full satisfaction of such violation.

G. Parking meters.

(1) The Town of Phillipsburg shall have the authority to provide for the installation, regulation, control, operation, and use of parking meters and parking lots under the jurisdiction of the Town.

(2) The installation of parking meters in an amount greater than 50% of the number of allocated parking spaces in parking lots under the jurisdiction of the Town of Phillipsburg shall require the approval of the Town Council of the Town of Phillipsburg.

H. Unauthorized use prohibited.

(1) No person shall be permitted to use the parking lots owned by the Town of Phillipsburg for purposes other than those intended by the Town of Phillipsburg in designating the area for the parking of motor vehicles.

(2) Unauthorized purposes and prohibited conduct shall include, but not be limited to, using the parking lots for the following: loitering, congregating, skateboarding, snowboarding, skating, skiing, bicycle riding, dirt-bike riding, kite-flying, playing, athletic contests, commission of a crime and furtherance of a criminal act.

(3) Anyone found in violation of this section shall be subject to a penalty established in accordance with the local Violations Bureau schedule.

I. Persons parking in the following municipal lots will be permitted subject to and in accordance with the terms and conditions set forth in this subsection:

(1) The following municipal parking lot zones are hereby created and parking within the lot situated in each zone shall be permitted subject to and in accordance with the terms and conditions set forth in this subsection as follows:

(a) Hudson/Brainard lot. Parking shall be by permit only for approximately 29 spaces and in accordance with the provisions of this Subsection I and shall be available only to businesses and residences within Blocks 914, 915, 922 on the tax map of the Town of Phillipsburg;

(b) Cedar alley lot. Parking shall be by permit only for approximately 10 spaces and in accordance with the provisions of this Subsection I and shall be available only to businesses and residences abutting Cedar Alley;

(c) Rectory lot. Parking shall be by permit only for approximately 28 spaces and in accordance with the provisions of this Subsection I and shall be available only to businesses and residences abutting South Main between Fox Street and Stockton Street; Fox Street between South Main and Cedar Alley; and Cedar Ally between Fox Street and Stockton Street;

(d) Stockton lot. Parking shall be by permit only for approximately 45 spaces and in accordance with the provisions of this Subsection I and shall be available only to businesses and residences abutting Sitgreaves Street between Jersey Street and Stockton Street;

(e) Sitgreaves lot. Parking shall be both metered and permit, with 10 permits issued in accordance with the provisions of this Subsection I made available to businesses and residences abutting South Main Street from Cross Street to Jersey Street; Sitgreaves Street from Jersey Street to South Main Street; and Jersey Street from South Main Street to Sitgreaves Street;

(f) Market lot. Parking shall be both metered and permit, with 15 permits issued in accordance with the provisions of this Subsection I made available to businesses and residences abutting South Main Street between Hudson and Market Street; Market Street between Church and Elizabeth; and Elizabeth Street between Stryker and Church;

(g) Riverside way. Parking shall be both metered and permit, 25 permits issued in accordance with the provisions of this Subsection I made available to businesses and residences abutting South Main Street between Union Square and Pleasant; and North Main Street between Morris and Broad;

(h) Church lot. Parking shall be metered only.

(2) The municipal parking lots will be open 24 hours a day, seven days a week with paid parking for metered lots from 8:00 a.m. until 8:00 p.m. daily. During non-Town sponsored special events, the lot hours will be extended from 8:00 a.m. until 10:00 p.m. The rate of parking fees per vehicle will be as follows:

(a) The normal rate, with the exceptions provided in Subsection I(2)(b) and (c) below and excepting Riverside Way Lot, will be $0.25 per 15 minutes, or $1 per hour, with a minimum of one hour charged per vehicle in the above-mentioned municipal lots in which metered parking is permitted. The Riverside Way lot shall be one hour minimum at $1/hour, with increments of one hour, if paying in cash and one hour minimum at $1/hour with $0.25 per additional fifteen-minute increments.

(b) During non-Town-sponsored special events, the municipal lots shall impose a flat rate of $10 per vehicle for parking. For Town-sponsored special events such as Ole Towne Festival, or participants in the Shad Fishing Tournament, parking shall be free. During declared Town snow emergencies requiring off-street parking, there shall be no charge to utilize the Town lots during the snow emergency and for a period of 24 hours after the snow emergency has ended. Thereafter, all vehicles in the Town lots shall be subject to the payment requirements (metered/permit) of the Town.

(c) Parking for boats and trailers shall only be permitted in the Riverside Way Lot and only in designated parking spaces designated for such use and shall be subject to a minimum rate of $10 for up to four hours for parking, and $20 for parking in excess of four hours. The Town shall make available an annual permit for trailer parking the amount of $100 for sportsmen utilizing the Riverside Way Lot. Any such person displaying the permit must have a trailer attached to his/her vehicle and must utilize a trailer parking space. In cases of special events, the Town may waive the parking fee for trailers.

(d) For residences and businesses located in a lot-specific zone who wish to purchase a permit for the specific lot, the administration will conduct a lottery of interested applicants and will promulgate rules and regulations to effectuate the intention of this subsection. Permits shall be valid for one year and shall be lot specific to eligible residents or businesses. Initial permits issued pursuant to this subsection shall expire on December 31, 2023. Permits shall cost $100/per year per permit issued, with initial permits being prorated for 2022 on a monthly basis for 2022 in addition to the $100 for 2023. Thereafter, the Town shall conduct a drawing for the subsequent year's permits no later than November 30 of the current year. The Town shall issue placards which shall be transferable only as to businesses which may have a permit amongst its employees of the business holding such placard. No business or organization which leases, even if for nominal consideration, parking from the Town shall be entitled to any permit issued pursuant to this subsection.

(e) Handicapped parking spaces shall be designated in each lot in accordance with applicable law.

(f) "Metered" shall mean paid parking through the use of either kiosks or individual parking meters.

(g) The Town shall place appropriate signage as needed in order to effectuate the intention of this subsection.

§ 67-28.1 Schedule XIV, School Bus Loading Zones.

The locations described are hereby designated as school bus loading zones. No vehicle except a school bus shall park in said location during the time indicated other than for the loading and unloading of children.
