No travel show or exhibition, razzle-dazzle or group of shows and exhibitions
popularly known and designated as "carnival exhibitions" shall exhibit shows
or do business within the Town of Phillipsburg without a license first had
and obtained as hereinafter set forth.
Application for a license for such carnival show or exhibition shall
be made in writing to the Town Council of the Town of Phillipsburg, two weeks
before any action shall be taken by the Town Council upon the granting of
any such license and notice of the application for license shall be published
once in at least two daily newspapers circulating in the Town of Phillipsburg.
Said application and said notice of application shall set forth the name of
the manager of such carnival and all persons or organizations whether incorporated
or not who shall have any interest in or receive any money from the receipts
at such carnival and shall state in detail the nature of the exhibition or
shows, the location and place where the carnival or exhibition shall be held.
Said license shall not be granted by the Town Council if a petition,
signed by 100 freeholders of the Town of Phillipsburg, remonstrating against
the granting of said license shall be filed on or before the day when the
granting of the application for the license shall be taken into consideration.
If no remonstrance is filed, the Town Council may grant the said license
as in its judgment it may deem fit and proper.

The fee for any such license shall be $100 per day.
This chapter shall not apply to any show or exhibition actually conducted
by the members of any organization or corporation doing business in the Town
of Phillipsburg.
In case a license is granted, the licensee shall conform to all police
regulations of the Town of Phillipsburg and to the laws of New Jersey and
the ordinances of said Town, and upon failure so to do, said license may be
revoked by the Mayor of the Town of Phillipsburg by serving notice in writing
upon said licensee.

Each and every person violating any of the provisions of this chapter shall, upon conviction thereof, be punished as provided in Chapter
1, General Provisions, Article
II, General Penalty; and the Municipal Court Judge before whom any such person may be brought may impose such punishment by fine or imprisonment in the county jail as he may see fit, not exceeding the maximum herein fixed.
