This ordinance shall establish a new chapter in the Code of the Borough of River Edge. Said chapter shall be Number 206 and shall begin on page 206:1 of the Code of the Borough of River Edge. This Chapter 206, starting on page 206:1, shall include the listing of all fees and charges for permits, licenses and applications, which listing was kept on file with the Borough Clerk at the time of legal adoption of Ordinance No. 1172.
Chapter 206 of the Code of the Borough of River Edge is hereby amended and supplemented by the addition and changes thereto of the following, which shall be added or changed to the list of fees and charges on file with the Borough Clerk:
Fingerprinting (noncriminal): $10.
Zoning booklet: $18.

Minimum fee. The minimum fee for a basic construction permit covering any or all of building, plumbing, electrical, elevator or fire protection work shall be $75 for Use Groups R-3, R-4 and R-5. The minimum fee for all subcodes for all other use groups shall be $100. All fees shall be rounded to the nearest dollar amount.
The Building Subcode fee shall be:
For new construction:
Use group classification shall be according to the building subcode as adopted by N.J.A.C. 5:23-3.
For renovation, alteration and repair: Fees shall be based upon the estimated cost of work.
For additions: $0.08 per cubic foot of building or structure volume for the added portion for all use groups.
For combinations of renovations and additions, the sum of the fees computed separately: renovation and addition.
For the demolition or removal of a building or structure: $200 for a structure of less than 5,000 square feet in area and less than 30 feet in height, for one- or two-family residences (Use Group R-3 or R-5 of the building subcode) and $325 for other use groups.
The Plumbing Subcode fee shall be:
Per fixture or stack for all fixtures except as listed below: $20.
For special devices such as grease traps, oil separators, water-cooled air-conditioning units, refrigeration units, utility service connections, sewer pumps, interceptors, gas piping (not in conjunction with an appliance installation), gas service entrances, active solar energy systems, pool heaters and underground lawn sprinkling system: $75.
Sanitary sewer connection or sanitary sewer replacement: $75.
Gas clothes dryers (each): $25.
Gas ovens or ranges (each): $25.
Residential (R-3, R-4 or R-5) hot water heater: $60.
Domestic water to well cross connections: $100.
The Electrical Subcode fee shall be as follows:
Total number of electrical fixtures and devices:
One through 25: $50.
Each additional 25: $8.
To include: lighting fixtures, wall switches, florescent fixtures, and heat detectors; communication outlets; light standards eight feet or less in height, including luminaries, emergency lights, electric signs, exit lights or similar electric fixtures; and devices rated 20 amperes or less, including motors or equipment rated less than one horsepower (hp) or one kilowatt (kw).
Each replacement of wiring involving one branch circuit or part thereof: $20.
Each storable pool or hydro massage bathtub: $20.
Each underwater lighting fixture: $20.
Household electric cooking equipment up to 16 kw: $20.
Each fire, security or burglar alarm control unit: $20.
Each light-standard greater than eight feet in height, including luminaries: $20.
Each communication closet: $20.
Each electric sign rated 21 to 225 amperes, including associated disconnecting means: $60.
Each utility load management device: $60.
Each electrical device or transformer or generator:
Swimming pools, spas, hot tubs and fountains:
Permanently installed private (Use Groups R-3, R-4 and R-5): $116.
Temporary installed private (Use Groups R-3, R-4 and R-5): $75.
Permanent or temporary private (all other use groups): $150.
For the purpose of computing fees, all motors except those in plug-in appliances shall be counted, including control equipment, generators, transformers and all heating, cooking or other devices consuming or generating electrical current.
The Fire Subcode fee shall be as follows:
Standpipe system (each riser): $200.
Kitchen hood exhaust system: $200.
Automatic fire alarm system/smoke, heat and carbon monoxide detectors:
Emergency response radio system:
Water main for fire service: $135.
Fire hydrant on private property (yard hydrant) (each): $135.
The Elevator Safety Subcode fee:
Witnessing acceptance tests and performing inspections:
Elevator devices in structures not in Use Group R-3, R-4 and R-5:
Hydraulic elevators: $302.
Roped hydraulic elevator: $340.
Escalators, moving walks: $302.
Stairway chairlifts, inclined and vertical wheelchair lifts and manlifts: $76.
Elevator devices in structures in Use Groups R-3, R-4 and R-5: $227. This fee shall be waived when signed statements and supporting inspection and acceptance test reports are filed by an approved qualified agent or agency in accordance with N.J.A.C. 5:23-2.19 and 5:23-2.20.
Witnessing acceptance tests of, and performing inspections of alterations: $76.
Routine and periodic tests and inspections for elevator devices in structures not in Use Groups R-3, R-4 and R-5:
One-year periodic inspection and witnessing of tests of elevator devices, which shall include routine inspection:
Hydraulic elevators: $227.
Roped hydraulic elevators: $302.
Escalators, moving walks: $484.
Manlifts, stairway chairlifts, inclined and vertical wheelchair lifts: $183.
Certificates and other permits.
Certificate of occupancy: New construction fee shall be in the amount of 10% of the new construction permit fee that would be charged by the Department. The minimum fee shall be $100, except for one- or two-family (Use Group R-3, R-4 or R-5 of the building subcode) structures of less than 5,000 square feet in area and less than 30 feet in height, and structures on farms, including commercial farm buildings subject to N.J.A.C. 5:23-3.2(d), for which the minimum fee shall be $50.
Certificate of occupancy granted pursuant to a use group change shall be $240.
Certificate of approval/compliance:
First issuance or renewal of a temporary certificate of occupancy: $35.
Exception: There shall be no fee for the first issuance of the temporary certificate, provided the certificate of occupancy fee is paid at that time.
Exception: Where a written request for a temporary certificate of occupancy is made for reasons other than uncompleted work covered by permit (such as uncompleted work required by prior approvals from state or municipal agencies), no renewal fee will be charged.
Application for a variation: $50.
Plan review. The fee shall be 20% of the amount to be charged for the construction permit and shall be paid before the plans are reviewed. The amount paid for this fee shall be credited toward the amount of the fee to be charged for the construction permit. This fee is not refundable.
Miscellaneous. The fee for a construction permit for any item requiring a construction permit not specifically addressed shall be $60 unless otherwise specifically set by other subcode or municipal ordinance.
Training fee. In order to provide training, certification and technical support programs required by the Uniform Construction Code Act and the regulations promulgated thereunder, the enforcing agency shall collect, in addition to the fees specified above, a surcharge fee as per N.J.A.C. 5:23-4.19(b). Said surcharge fee shall be remitted to the Construction Code Element, Division of Housing and Development, Department of Community Affairs, on a regular quarterly basis.

Annual permits. The fee to be charged for an annual construction permit shall be charged annually. This fee shall be a flat fee based upon the number of maintenance workers who are employed by the facility and who are primarily engaged in work that is governed by a subcode. Managers, engineers and clericals shall not be considered maintenance workers for the purpose of establishing the annual construction permit fee. Annual permits may be issued for building, fire protection, electrical and plumbing. Fees shall be as follows:
Prior to the issuance of an annual permit, a training registration fee of $100 per subcode shall be submitted by the applicant to the municipal construction official, who shall forward the fee to the Department of Community Affairs, Construction Code Element, Bureau of Technical Services, along with copies of the construction permit (Form 170). Checks shall be made payable to the "Treasurer, State of New Jersey."
Fee schedule revision. The Construction Official shall, with the advice of the subcode officials, prepare and submit to the Borough Council, biannually, a report recommending a fee schedule based on the operating expenses of the agency and any other expenses of the municipality fairly attributable to the enforcement of the New Jersey State Uniform Construction Code Act.
Private on-site inspection and plan review agencies. Private on-site inspection and review agency under contract shall comply with the regulations and fees pursuant to N.J.A.C. 5:23 et seq.
Administrative surcharge. A surcharge fee of 15% shall be added to each subcode fee in which plan review and inspections are performed by an on-site agency under contract with the municipality.
Public Defender application fee: up to $200 (per P.L. 1997, c. 256, N.J.S.A. 2B:24-1 et seq.). The fee, in whole or part, is waivable by the Judge of the Municipal Court.

Tax sale notice mailing fee: $25 per mailing.

Tax sale certificate redemption calculation, two redemption calculations in a calendar year for any party that holds interest in the property: no charge.
Each subsequent calculation requested of the Tax Collector: $50.
Redemption calculation requested by a lien holder on a certificate they own: $50.
Police outside duty: $135 per hour.

Hazardous material reimbursement for services: billed amount for any recovery company, towing company or any other technical assistance called for by the Borough to handle such incident.

Street opening permit.

Application fee (minimum fee): $250 (plus $0.75 per linear foot over 100 linear feet).
Fee for failure to apply for a road opening permit: $500 (forty-eight-hour grace period for emergency road opening).
Inspection fee (minimum fee): $300 (includes up to four inspections of a maximum duration of one hour each; any additional inspections thereafter shall be paid at the rate of $75 per hour, one hour minimum).
Performance escrow (refundable): $500.
Permanent maintenance fee (nonrefundable): shall be paid prior to the release of the performance escrow.
Roads resurfaced within the five years prior to the date of permit application: $12 per square yard of road disturbance/damage with a minimum charge of $100.
Roads not resurfaced within the five years prior to the date of application: $7.50 per square yard of road disturbance/damage with a minimum charge of $50.
Waiver of fees - municipalities: road opening permit fees may be waived for municipal projects in connection with county roads, including but not limited to handicap ramp installation curb replacement projects, and streetscape projects. Notwithstanding anything to the contrary, road opening permit fees apply to all municipally owned utilities and may not be waived.
Violations of road opening ordinance and/or procedures: up to $2,000 per occurrence.

Municipal Court discovery. The following fees shall be payable by the requestor to the Borough of River Edge for requested discovery in matters pending in the River Edge Municipal Court:

Actual postage for any discovery sent by mail.
For any discovery sent by mail: $0.25 per envelope.
Photographs will be photocopied at the rates established herein. If requests are made for duplicate photographs, the actual cost of making the photographs shall be charged.
Duplication of videotapes and discs, including audio and video discs, constitutes an extraordinary duplication process and will be charged at the rate of $5 per copy.
On any item that cannot be photocopied on Borough equipment or not otherwise provided for in this schedule, the actual cost incurred in making the copy shall be charged.
Where the discovery must be obtained from an entity other than the Borough of River Edge, e.g., another police department, the actual costs paid to the other entity shall be paid by the requestor.

Surcharge for food establishments which have more than one conditional rating during any one calendar year: $50.

False fire alarms.

Second false fire alarm in any twelve-month period, after a ten-business-day warning, a fee of $50 to cover the cost of service shall be paid to the Borough.
Third false fire alarm in any twelve-month period and any subsequent false fire alarm, a fee of $100 to cover the cost of service shall be paid to the Borough.
All false fire alarm fees are waived for Borough-owned buildings.
False sewer blockage callout.

Second false sewer blockage callout in any twelve-month period, after a ten-business-day warning, a fee of $50 to cover the cost of service shall be paid to the Borough.

Tax Assessor list of property owners for notice of adjacent property: $0.25 per name or $10, whichever is greater.

Court violations and penalties. Unless another penalty is expressly provided by New Jersey statute, any person convicted of a violation of this chapter, or any supplement thereto, shall be liable to a penalty of not more than $300 or imprisonment for a term not exceeding 15 days, or both.

Summer playground program:
Sponsorship: A sponsor may offer monetary or other acceptable material support to any authorized Borough program or related activity. This may include, but not necessarily be limited to, providing financial support to a Borough recreation program, activity or facility improvement or modification that provides a public benefit, subject to any applicable laws, ordinances and authorization by the governing body or Borough Administrator. Sponsors shall be entitled to recognition or acknowledgment by way of public address, approved signage, written announcements, correspondence or other appropriate means, subject to the following standard terms and conditions:
All sponsorship proposals equal to or less than $5,000, including creation of sublevels may be set and approved by the Borough Administrator. Proposals in excess of $5,000 in material value are required to be approved by the governing body upon the recommendation of the Borough Administrator.
No program participant, Borough employee or official shall be required to participate in surveys or focus groups as a condition of any such sponsorship.
Such recognition in any manner shall not constitute the Borough's endorsement of any product, service or program provided by the sponsor.
All sponsorships shall be appropriate for audiences of all ages and shall not promote any illegal or discriminatory activity.
