The local Board of Health shall consist of five members
who shall be appointed by the Township Committee. Of the first members
of the Board appointed, one member so appointed shall be appointed
for the term of one year, two for the term of two years and two for
the term of three years; and thereafter members of the Board of Health
shall hold office for terms of three years. If any vacancy occurs
in the Board by the death, resignation or inability of any member
to serve or from any other cause, the appointment to fill that vacancy
shall be made in the same manner in which the original appointments
are to be made, but for the unexpired term only.
The local Board of Health may also have not more than
two alternate members appointed by the Township Committee. Alternate
members shall be designated at the time of appointment as "Alternate
1" and "Alternate 2" and shall serve during the absence or disqualification
of any regular member or members. The terms of the alternate members
shall be two years, except that the terms of the two alternate members
first appointed, shall be two years for Alternate No. 1 and one year
for Alternate No. 2, so that the term of not more than one alternate
member shall expire in any one year. A vacancy occurring otherwise
than by expiration of term shall be filled by the appointing authority
for the unexpired term only. An alternate member shall not be permitted
to act on any matter in which he has either directly or indirectly
any personal or financial interest. An alternate member may, after
public hearing if he requests one, be removed by the governing body
for cause. An alternate member may participate in discussions of the
proceedings but may not vote except in the absence or disqualification
of a regular member. A vote shall not be delayed in order that a regular
member may vote instead of an alternate member. In the event that
a choice must be made as to which alternate member is to vote, Alternate
No. 1 shall vote first.
The local Board of Health shall appoint such officers
as required by statute and may appoint such other officers or assistants
as it may deem necessary. All appointees of the Board shall be governed
by the rules of the Board and shall be subject to all laws, rules
and regulations governing such officers, and they may be removed for
cause by the Board.
The Board of Health shall adopt bylaws governing its
procedural operation. It shall elect a Chairman and Vice Chairman
from among its members and shall appoint a Secretary who shall keep
an accurate record of all official actions of the Board and perform
such other duties as may be assigned. The Board may create and fill
such other offices as it shall determine. It shall have the power
and authority to employ experts and a staff for enforcement and carrying
out its purposes, including a health officer and other persons provided
by law, and to pay for their services and such other expenses as may
be necessary and proper, not exceeding in all the amount appropriated
by the Township for the use of the Board of Health.
The Board of Health shall have the powers and perform
the duties prescribed by law and by municipal ordinance. It shall
be the duty of the Board of Health to enforce all ordinances of the
Township which relate to public health or nuisances.
The Board of Health shall make all necessary rules
and regulations for the protection of the health of the inhabitants
of the Township and to guard against the spread of contagious diseases
and to prevent by necessary rules the induction of disease, contagious
or otherwise, within the boundaries of the Township.
