As used in this chapter, the following terms shall have the meanings
indicated:
PRIVATE POOLS
Applies to pools located in or above the ground, both permanent and
portable, having a water depth exceeding 12 inches, and owned by individuals,
groups of individuals, clubs or any type of organizations.
SWIMMING POOL
Includes fill and draw flow-through and recirculation pools, outdoor
and indoor, which are artificially constructed to provide recreational facilities
for swimming, bathing or wading and all buildings, equipment and appurtenances
thereto. It shall not include outdoor ponds, rivers or lakes, nor baths used
for cleansing of the body or practice of the healing arts.
No discharge of water shall be permitted from any pool except to a brook,
dry-well seepage pit, storm sewer or lawn sprinkling system. Under no circumstances
shall water from any pool be permitted to flow, overflow, seep or drain onto
adjacent property.

Fencing requirements for all in-ground pools shall be in accordance
with the BOCA Basic Building Code/1978.
Lighting used above the surface of the water to illuminate any private
swimming pools shall be so arranged and shielded that the light is reflected
away from adjoining premises.

All existing private swimming pools which do not fall within the requirements of §
179-3 shall be fenced, as herein required under §
179-7, within 120 days of enactment of this chapter.

A. Any access ladder or steps with any above-the-surface-type
swimming pools, whether permanent or portable, shall be removed from the pool
when not in use. "Removal" shall be defined as not capable of being used to
enter the pool.
B. Above-the-surface pools which do not have smooth, unbroken
vertical sidewalls or equally unclimbable, vertically reinforced sides four
feet or more in height above the surface of the ground shall be completely
enclosed by a permanent fence of durable material at least four feet in height,
which fence shall be constructed so as not to have openings, holes or gaps
larger than two inches measured horizontally, except that chain link fencing
may have openings not greater than two inches measured on any side. The fence
shall be located a minimum of three feet from the waterline of any portion
of the pool. If a pool has attached thereto a raised deck, the fence shall
be located no closer than three feet from the raised deck. All gates and doors
used in conjunction with the fence shall meet the same specifications as the
fence itself and shall be equipped with locking devices which are self-closing.
Gates shall be locked at all times that a pool is not in use. All self-latching
devices shall be placed at the top of the gate and make inaccessible to small
children.

A Board of Review is hereby established consisting of the members of
the Township Committee. The Board of Review shall hear and decide requests
for exemptions from the requirements of this chapter.
