In accordance with the provisions of N.J.S.A. 26:3-69.2, the Board of
Health of the Township of Washington, Morris County, New Jersey, hereby adopts
by reference the Public Recreational Bathing Code of New Jersey (2000), including
any amendments which may be made thereto. A copy of the Public Recreational
Bathing Code is attached hereto and made part of this chapter without the
text being included herein.
Three copies of the Public Recreational Bathing Code have been placed
on file in the office of the Secretary of the Board of Health and the Township
Clerk for use and examination by the public.

It shall be unlawful for any person to locate and construct or operate
a swimming pool, bathing beach, public bathing place, hot tub or spa, as defined
in the Public Recreational Bathing Code, without first having obtained approval
from the Board of Health.

A. The fee for filing an application and plans for a permit to locate
and construct a swimming pool, bathing beach, public bathing place, hot tub
or spa, as defined in the Public Recreational Bathing Code, shall be $200
for the initial submission. The fee for subsequent revision submissions shall
be $150.
B. The fee for an annual license to operate a swimming pool, bathing
beach or public bathing place shall be $200. All reinspection fees shall be
$50. The fee for a license to operate a hot tub shall be $200. The reinspection
fees shall be $50.
The New Jersey State Sanitary Code, Chapter IX, Public Recreational
Bathing Code, is hereby amended, in part, to read as follows:
A. Subchapter 5, Waterfront Safety, 5.1, Exceptions, is
amended as follows:
(1) The provisions set forth in N.J.A.C. 8:26-5.1(a) and
(b) are not applicable.
(2) N.J.A.C. 8:26-5.2(b) is hereby revised to read as follows:
"At least one person currently certified in standard first aid and professional
level infant, child and cardiopulmonary resuscitation (CPR) by a Department
of Health and Senior Services approved organization as listed in the Appendix
shall be at poolside when the pool is in use."
(3) N.J.A.C. 8:26-5.6(b) is hereby revised to read as follows:
"A wading pool shall have a person currently certified in standard first aid
and professional level infant, child and cardiopulmonary resuscitation (CPR)
by a Department of Health and Senior Services approved organization as listed
in the Appendix at poolside when the wading pool is in use."
(4) N.J.A.C. 8:26-5.8(b) is hereby revised to read as follows:
"At least one person currently certified in standard first aid and professional
level infant, child and cardiopulmonary resuscitation (CPR) by a Department
of Health and Senior Services approved organization as listed in the Appendix
shall be on the premises, available and readily accessible when the hot tub
or spa is in use."
(5) N.J.A.C. 8:26-5.10(b) is hereby revised to read as follows:
"At least one person currently certified in standard first aid and professional
level infant, child and cardiopulmonary resuscitation (CPR) by a Department
of Health and Senior Services approved organization as listed in the Appendix
shall be at lakeside when the bathing beach is in use."
Any person who violates any provision of this chapter or code established herein shall, upon conviction thereof be liable to penalties in accordance with Chapter
221, General Provisions, §
221-2, General penalty.
