This chapter is enacted to regulate the sale and transportation of alcoholic beverages in the municipality in accordance with the provisions of an act of the Legislature of the State New Jersey entitled An Act Concerning Alcoholic Beverages, comprising Chapter 436 of the Laws of 1933, its supplements and amendments, and also comprising N.J.S.A. 33:1-1 et seq. and in accordance with the rules and regulations of the State Director of Alcoholic Beverage Control.
For the purpose of this article, words and phrases herein shall have the same meanings as in N.J.S.A. 33:1-1 et seq., and the rules and regulations of the Director of the Division of Alcoholic Beverage Control.
A. 
Laws applicable. All applications for licenses, all licenses issued and all proceedings under this chapter shall be in accordance with the act, rules and regulations referred in § 74-1, and all other applicable laws of the State of New Jersey or the United States.
B. 
Issuing authority. All licenses required by this chapter shall be issued by the Township of Weymouth, which shall also administer the provisions of this article.
C. 
License required. No person shall sell or distribute alcoholic beverages within the Township of Weymouth without obtaining a license in accordance with the act referred to in § 74-1 and the provisions of this article.

A. 
Plenary retail consumption license. The annual license fee for the year 2000 and for each year thereafter shall be $622.
B. 
Plenary retail distribution license. The annual license fee for the year 2000 and for each year thereafter shall be $622.
C. 
Club license. The annual license fee shall be $150.
A. 
Hours of sale. No alcoholic beverages shall be sold, delivered or served to or consumed in any licensed premises on any day between the hours of 5:00 a.m. and 6:00 a.m.
B. 
Outside lighting. The licensee or employee of the licensee shall extinguish, or cause to be extinguished, all lights outside of the licensed premises between the hours of 4:00 a.m. and 6:00 a.m., but the inside lights in the part of the premises licensed shall be extinguished from 5:00 a.m. to 6:00 a.m.
C. 
Sales to certain persons. No licensee or employee of a licensee shall sell, serve or deliver, directly or indirectly, any alcoholic beverages to any habitual drunkard, intoxicated person or minor, nor permit the consumption of alcoholic beverages on any licensed premises by any of the above named classes or persons, or permit any such persons to congregate in or about the licensed premises.
D. 
Closing provision. During the hours that the sale of alcoholic beverages are prohibited, the entire licensed premises shall also be closed and no person shall be admitted or permitted to remain therein except the licensee or bona fide employees of the licensee.
E. 
Regulations for club licenses.
(1) 
Club licenses shall be issued only to such corporations, associations and organizations as are operated for benevolent, charitable, fraternal, social, religious, recreational, athletic or similar purposes, and not for private gain, and shall comply with all conditions which may be imposed by the New Jersey Commissioner of Alcoholic Beverage Control by rules and regulations.
(2) 
The holder of any alcoholic beverage club license in the Township shall be required to extinguish, or cause to be extinguished, all lights outside of the licensed premises between the hours of 4:00 a.m. and 6:00 a.m. and the licensed premises shall close and remain completely closed for business from 5:00 a.m. to 6:00 a.m. daily.
F. 
Distance required between licensed premises.
(1) 
No licenses for the sale of alcoholic beverages shall be granted, issued or transferred to any premises which are situated within 2,000 feet of any other licenses premises.
(2) 
The distance requirements between one liquor establishment and another, if there is more than one way by which a pedestrian could properly go from one place to the other, shall be the shortest route to govern.
No licensee shall sell or serve any alcoholic beverages to any person under the age of 21 years of age, except as provided by state statute.
A. 
Any license issued under this article may be suspended or revoked for violation of any of the provisions of this article or any provision of any applicable statute or any of the rules or regulations of the State Director of Alcoholic Beverage Control.
B. 
Proceedings for suspension or revocation shall be in accordance with the provisions of N.J.S.A. 33:1-31 by a service of a five-day notice of charges preferred against the licensee and affording a reasonable opportunity for a hearing.
C. 
Suspension or revocation of a license shall be in addition to any other penalty which may be imposed for a violation of this chapter.

Except as may be provided in N.J.S.A. 33:1-1 et seq., a violation of this article shall be punishable by the penalties as set forth in Chapter 1, General Provisions, Art. III, General Penalty.

A. 
The consumption of alcoholic beverages in unlicensed premises is hereby prohibited.
B. 
No person owning or operating any restaurant, dining room or other public place where food or liquid refreshments are sold or served to the general public, and for which place a license or permit authorizing the sale of alcoholic beverages for on-premises consumption has not been issued, shall permit allow or suffer the consumption of alcoholic beverages at such restaurant, dining room or public place.

Except as may be provided in N.J.S.A. 33:1-1 et seq., a violation of this article shall be punishable by the penalties as set forth in Chapter 1, General Provisions, Article III, General Penalty.
