At such time as preliminary plans are submitted
to the Borough of Moosic, a developer shall also submit three copies
of said plans to the Borough along with a request for reserved capacity
in the system and the required plan review fee, if so requested by
the Borough, is paid in full at the rate established in the Schedule
of Tariffs.
After the Borough has determined that the requested
flow can be allowed to enter the system from a development, the developer
shall submit six copies of preliminary sewer extension plans to the
Borough showing the location of sewer mains, sewer main rights-of-way,
size of sewer mains, direction of flow, distance of sewer mains from
any structure, location of existing mains and manholes to which connection
is to be made.
Upon approval of the preliminary sewer extension
plans by the Borough and the approval of the preliminary plans by
the Planning Commission and payment of any applicable fees by the
developer, the developer shall submit to the Borough six copies of
the final sewer extension plans with specifications which shall include
all rights-of-way at least 30 feet wide, which the developer intends
to grant to the Borough, where lines will be outside of public streets,
depth of all lines, profile drawings, locations of all manholes, distance
of lines from any above or below ground structures, the location of
any specialized equipment or pumps. When final sewer extension plans
and specifications are submitted the developer shall also file a completed
application for a sewer extension permit from the applicable modules,
federal agency in the same name of the Borough, and all applicable
modules, supporting documents and supplementary reports as required.
The final plan review fee must be submitted before any final plan
review can be started.
Upon receipt of the permit as issued by the
applicable state and/or federal agency, the developer must record
the same in the Recorder of Deeds' office located in Lackawanna County
Courthouse in Scranton, Pennsylvania, and file proof of same with
the Borough.
Prior to starting construction of the new facilities the developer must provide coverage satisfactory to the Borough in both limits and coverage, as may be specified in Article
X herein.
Prior to starting construction the developer
must deliver to the Borough proof of right-of-way over any lands not
owned by the developer but necessary for the sewer extension, including
but not limited to the state, county and local highways or trafficways.
The developer shall submit a schedule of construction
upon completion of all requirements in this article which will be
used to estimate the construction inspection fees. This fee shall
be submitted prior to any construction started by the developer.
Construction of new facilities shall be completed
within 18 months starting upon acceptance by the Borough of the final
sewer extension plans. A time extension may be granted by the Borough
and, if time extensions are granted, the developer must submit any
necessary fees required by the Borough and such fees shall be used
to offset the additional costs of inspection or plan review, and these
fees shall be submitted within 10 days of the Borough's request for
such fees.
