A. For reasons
of hazardous traffic conditions, and the resulting public safety concerns
of the Borough of Tullytown, it shall be unlawful for any person to
operate a vehicle other than a passenger car on Main Street between
the municipal boundaries of Bristol Township - Tullytown Borough,
and Tullytown Borough - Falls Township, unless the vehicle is registered
to an address within the Borough or is related to a Borough business
or residence; provided, however, that nothing in this section shall
prohibit any person from driving an emergency vehicle on Main Street,
or any part of Main Street, or from driving a school bus, truck or
other commercial vehicle making local deliveries to, or pick ups from,
premises located along or reached via Main Street.
B. The following
types of documents will constitute evidence that a commercial vehicle
is classified as local traffic:
(1) A
bill of lading, shipping order, or similar document which shows a
destination on the posted highway;
(2) Certification
by the owner or operator of the vehicle on company letterhead describing
the local traffic nature of the activity in which the vehicle is engaged.
C. Any person
who violates any provision of this section shall, upon conviction,
be sentenced to pay a fine of not less than $100 for a first offense;
$300 for a second offense; and $500 for a third offense. Upon conviction
for a subsequent offense beyond a third, the fine will be in the amount
of $500. Costs will be assessed in addition to any fine ordered to
be paid.
