No person shall erect, construct, operate, conduct or maintain a public
garage, gasoline or oil service station or bulk gasoline or oil storage plant
in the borough, without first obtaining a permit so to do, in accordance with
the provisions hereof.
Any applicant for a permit to conduct a public garage, gasoline or oil
service station or bulk gasoline or oil storage plant in the borough shall
file an application with the Borough Clerk, setting forth the name of the
applicant, a description of the premises, its owner, and location, together
with a copy of the plans and specifications of all buildings and diagram showing
location of buildings, tanks, pumps and driveways on the premises.

The fee for a permit shall be as established in Chapter
127, Fees, Article
I, payable to the Borough Clerk at the time of issuance.
Any public garage, gasoline or oil storage plant existing at the time
of enactment of this chapter may be continued upon any lot or in any building
so occupied, and any such building may be restored or repaired in the event
of partial or total destruction thereof.

A. All gasoline filling stations in the borough shall be
closed and shall not engage in any business operations involving the sale
or dispensing of fuels, oils, goods or services, except for emergency road
services, during the hours of 12:00 midnight and 6:00 a.m.
B. Any person who violates this section by engaging in any prohibited business operations between the hours of 12:00 midnight and 6:00 a.m., upon conviction, shall be subject to the penalties stated in Chapter
1, General Provisions, Article
III, General Penalty. Each day that a violation of the provisions of this section occurs shall be considered to be a separate offense.
