The use or continued use by any operator or other person of land in
the township for the storage, collection, processing or disposal of solid
waste or other refuse materials contrary to the provisions of this chapter
shall be unlawful. Any such operator or other person so violating this chapter
shall upon conviction thereon in a summary proceeding before any District
Magistrate having jurisdiction, be sentenced to pay a fine of not more than
one thousand dollars ($1,000.) and costs of prosecution for each and every
offense, and in default of payment of such fine and costs, to imprisonment
in the county jail for not more than thirty (30) days; provided, however,
that for any violation for which the penalty or the term of imprisonment in
default of payment thereof is specifically proscribe in any of the laws of
the commonwealth, or is specifically limited by law to a maximum amount of
term less than the amount or term, as the case may be, set forth above, the
provision, of the state law shall be controlling. Each violation of a specific
provision of this chapter shall constitute a separate offense hereunder and
shall be punishable as such.
In addition to the remedies provided in §
77-22 above, any continued violations of this chapter constituting a nuisance in fact or which shall, in the opinion of the Township Board of Supervisors, constitute a nuisance, may be abated as such by proceedings against the violating operator or other person by action in equity or at law.
