rights therein.
The Municipality of Murrysville herein declares its property rights
in and to the municipal logo as depicted on Exhibit A, attached hereto and
made a part of this chapter, together with all similar depictions thereof
within the ambit of its property rights therein.
The Municipality of Murrysville will use the logo in the furtherance
of its public purposes, including but not limited to a depiction thereof on
municipal vehicles, stationery, business cards, municipal flags and signs.
The Council of the Municipality of Murrysville may prescribe additional uses
from time to time, and in the absence of such direction, as may be directed
from time to time by the Murrysville Chief Administrator.
The Municipality of Murrysville will, upon request, entertain use of
the municipal logo by others in the furtherance of the public purposes and
interests of the Municipality. A use by others shall be undertaken only upon
application made setting forth the proposed use and the municipal purposes
and/or interests being furthered by the proposed use:
A. Each application shall be submitted to the Council of
the Municipality of Murrysville for review and a decision on whether to approve
or disapprove the grant of a license for the proposed use.
B. If approved, the use shall be deemed a mere license.
Such license shall be revocable at the sole election or discretion of the
Municipality of Murrysville if it determines the municipal purposes or interests
are no longer being furthered by such use or at the expiration of any fixed
term established for a license, whichever shall first occur.
C. Murrysville's determination: 1) in approving or
disapproving a license; and/or 2) that a municipal purpose or interest is
no longer being furthered by continuation of such license; and/or 3) the expiration
of the fixed term of a license, shall be final and binding and not subject
to review by a court of competent jurisdiction.
