[Adopted by the Borough Council 4-6-1982 as Ch. 118, Art. III, of the 1981 Code]
For the purposes of this article the following words shall have the meanings ascribed to them by this section.
COLLECTOR
Any person who, for a consideration, transports rubbish from place to place or to a place of disposal for others. It shall not include any person who by use of his own vehicle operated by his own agents transports his own rubbish.
CONTAINER
Any thing or space where rubbish is accumulated or stored.
RUBBISH
Any and all kinds of waste material, such as ashes, tin cans, waste or discarded paper, etc., but excluding garbage, animal matter and animal offal.
VEHICLE
Any vehicle or equipment used to transport rubbish from place to place.

It shall be unlawful for any person to engage in the activities of a collector in the Borough of Norristown unless he shall have first registered with the borough at the office of the Health Department and shall have furnished the information required upon registration forms to be supplied by the borough, which shall require the names and home addresses of all persons interested in such business as well as the business location and shall identify all vehicles proposed to be used in such business.

A. 
Each person so registering shall, at the time of registering, pay to the borough a registration or license fee of $100 for each vehicle proposed to be used in said business. The license shall be on an annual basis. The license year shall be from January 1 to December 31 following.
B. 
Before issuance of any license, an inspection of equipment used in the collection and transportation of garbage and rubbish will be made by the Health Officer of the Borough of Norristown or by his qualified assistant at a place and time to be designated by such Officer. Inadequate or improper equipment revealed as a result of such inspection as determined by the Health Officer of the Borough of Norristown or by his qualified assistant will be sufficient cause to withhold issuance of said license until such vehicle is conditioned according to the standards set forth in this article and other appropriate ordinances.
C. 
An inspection of equipment may be made at any time by the Health Officer or his qualified assistant, and if at any time such equipment is found to be inadequate or improper for the collection and transportation of rubbish and garbage, this shall be sufficient cause for the Health Officer of the Borough of Norristown or his qualified assistant to immediately withdraw or rescind the license until such vehicle or other equipment is conditioned according to the proper standards.
Each person registered as a collector under the provisions of this article shall be furnished two license plates for each vehicle designated upon such registration. A license plate shall be displayed on each side of each vehicle at all times when the same is used for the purposes of collection.
It shall be unlawful for any person, whether acting in the capacity of collector or otherwise, to transport, move from place to place or store or accumulate any rubbish unless the same shall be done in a vehicle or container sufficiently closed, covered or otherwise made tight so as to prevent any portion of such rubbish from spilling or blowing or being spilled or being blown upon any highway or private property. Any person who shall suffer, allow or permit any rubbish to be spilled, dropped or blown upon any highway or private property shall be guilty of a violation of this article.
No person shall transport in any vehicle rubbish of more than one classification at the same time unless the same shall be so separated and divided as to classifications as to enable it to be dumped or disposed of separately as to classifications.
Any person seeking to dump or dispose of any rubbish at any dump or disposal area under the supervision of the borough shall first request permission of the dump attendant in charge and pay the established fee. Such person shall permit the dump attendant to examine the load and shall dump the rubbish as to its different classifications at such places as the dump attendant shall indicate or direct.

It shall be unlawful for any person to dump or deposit any rubbish within the borough unless such place of deposit shall first have been approved as a proper dump by the Council, and it shall be unlawful for any person to deposit or dump any rubbish within the borough, even in or upon such places that shall be so approved, except between the hours of 8:00 a.m. and 4:30 p.m.

It shall be unlawful for any person to transport from outside the borough into the borough any garbage or rubbish as defined in this article and to deposit the same within the borough, whether or not the same is deposited in a place made available for the deposit of rubbish and garbage.

All persons accumulating or storing any garbage and rubbish shall do so in a manner to comply with all firesafety regulations or laws in force and shall, at all times, prevent any rodents or vermin from becoming established therein.

Any person who shall violate Article III or Article IV or any regulation adopted thereunder, upon a summary conviction according to law, shall be punished by a fine of not less than $50 nor more than $1,000 and, in default of the payment thereof, shall be imprisoned in the county jail for a period of 30 days, and each day's failure to comply with any such provision shall constitute a separate violation.
