The Board of Commissioners of the Township hereby
declares that disabled, dismantled or partially dismantled vehicles
upon any road, street or alley within the Township are obstructions
to said public thoroughfares and, as such, constitute a public nuisance.
It shall be unlawful for any person, firm or
corporation to maintain or allow his vehicle to remain upon any street
or alley in the Township in a disabled condition for a period of more
than two hours. If a vehicle being operated on any public road, street
or alley within the Township shall become disabled or incapable of
proceeding under its own power, it shall be the duty of the operator
of said vehicle, and of the owner thereof if he is aware of its condition,
to remove the same from the highway as soon as possible; and if the
same has not been removed in any other manner, it shall be the operator's
duty to remove the same by having it towed off the highway within
a period of two hours from the time it became disabled.
No person, firm or corporation shall dismantle,
partially dismantle or deliberately disable any vehicle while the
same is either wholly or partially upon any portion of any public
street, road or alley within the Township.
If any disabled vehicle is left on any road,
street or alley within the Township for a period of more than two
hours, then the same may be removed and impounded by the Township
in the same manner as hereinafter provided in this chapter for the
removing and impounding of illegally parked vehicles.
Any person violating any of the provisions of
this article shall, upon conviction thereof, be sentenced to pay a
fine of not less than $10 nor more than $100 for each offense, together
with payment of costs, and, in default of payment of fine and/or costs,
to imprisonment in accordance with the provision of the First Class
Township Code relating to the enforcement of ordinances of Townships
of the first class.
