The Borough Council of the Borough of Punxsutawney hereby expressly
finds that the unregulated use of skateboards, as hereafter defined, poses
a serious risk to the health and safety of pedestrian and vehicular traffic
within the Borough, and it is the express intention of this chapter to regulate
the use of skateboards for the purpose of preserving such health and safety.
For the purpose of this chapter, the following terms shall have the
meanings indicated:
SKATEBOARD
A single platform which is mounted on wheels, having no mechanism
or other device with which to steer or control the direction of movement thereof
while being used, propelled, operated or ridden.
It shall be unlawful for any person to engage in skateboarding or ride
upon or propel any skateboard upon any highway, street or alley within the
Borough of Punxsutawney or upon any of the sidewalks adjacent to the following
highways or streets:
A. East and West Mahoning Streets and North Main Street
from the intersection of Oakland Avenue to the intersection of State Route
436.
B. United States Route 119 from the intersection of Orchard
Avenue to the intersection of Indiana Street.
C. Hampton Avenue, sometimes still referred to as “Front
Street,” from the intersection of Union Street to the intersection of
East Mahoning Street.
D. Elk Run Avenue from the intersection of Marion Avenue
to the intersection of United States Route 119, also known as "Ridge Avenue."
E. North Gilpin Street from the intersection of West Mahoning
Street to the intersection of Pine Street.
F. Pine Street from the intersection of North Gilpin Street
to the intersection of North Findley Street.
G. South and North Findley Streets from the intersection
of Union Street to the intersection of Clark Avenue.
H. South and North Jefferson Streets from the intersection
of Union Street to the railroad right-of-way.
I. North Penn Street from the intersection of East Mahoning
Street to the railroad right-of-way.
It shall also be unlawful for any person to engage in skateboarding
or ride upon or propel any skateboard in or upon any public park, tennis court,
public parking lot or sidewalk adjacent to any of the same, nor shall any
person engage in skateboarding or ride upon or propel any skateboard upon
any private parking lots within the municipal limits of the Borough of Punxsutawney
without the express written permission of the owner of such private parking
lot.
It shall be unlawful for any person to engage in skateboarding or ride
upon or propel any skateboard upon any sidewalk or private parking lot within
the Borough of Punxsutawney between sunset and sunrise on any day and at any
other time when, due to insufficient light or unfavorable atmospheric conditions,
persons are not clearly discernible from a distance of 100 feet.
All persons engaged in skateboarding or riding upon or propelling any
skateboard shall obey the instructions of a police officer or other appropriately
attired person authorized to direct, control or regulate traffic and shall
obey all traffic and pedestrian control signals as provided in the Vehicle
Code, particularly §§ 3112 (relating to traffic-control signals)
and 3113 (relating to pedestrian-control signals).
All persons engaged in skateboarding or riding upon or propelling skateboards
shall yield the right-of-way to any pedestrian and shall not overtake or pass
a pedestrian while engaged in skateboarding or riding upon or propelling any
skateboard. The operator or rider of such skateboard shall dismount from the
skateboard and shall pass or overtake the pedestrian on foot or wait until
the pedestrian passes prior to remounting the skateboard.
No person engaged in skateboarding or riding upon or propelling a skateboard
shall suddenly leave a curb, sidewalk, berm or street or any other place of
safety and ride upon or propel any skateboard into or toward the path of a
vehicle which is so close as to constitute a hazard.

No parent or guardian of any minor child shall authorize or knowingly
permit such child to violate any of the provisions of this chapter. Upon the
issuance of a citation for a violation of this chapter, the issuing officer
shall notify, in writing, the parent or guardian of the offending minor of
the issuance of the citation.

A. Any person who shall violate any of the provisions of this chapter
as a first offense shall be guilty of a summary offense and shall, upon conviction,
be sentenced to pay a fine of not less than $25 and costs.
B. Any person who shall violate any of the provisions of this chapter
as a second offense shall, upon conviction, be sentenced to pay a fine of
not less than $100 and costs. In addition, the skateboard used in the offense
shall be impounded by the Punxsutawney Borough Police Department and only
released upon court order.
C. Any person who shall violate any of the provisions of this chapter
as a third or subsequent offense shall, upon conviction, pay a fine of not
less than $300 nor more than $600 and costs. In addition, the skateboard used
in the offense shall be confiscated by the Punxsutawney Borough Police Department
and only released upon court order.

In the event that any provision, section, sentence, clause or part of
this chapter shall be held to be invalid, such invalidity shall not affect
or impair any remaining provision of the chapter, it being the intent of the
Borough Council that the remaining portion or portions shall be and remain
in full force and effect.

Any provisions of any other ordinance which conflict with the provisions
of this ordinance are repealed.
