The City of Scranton hereby adopts and incorporates
by reference the following codes of the Uniform Construction Code.
A. Pennsylvania Construction Code Act 45 of 1999, 35
P.S. §§ 7210.101 – 7210.1103, as may be amended
from time to time.
B. Title 34, Labor and Industry, PART XIV, Uniform Construction
Code, Chapters 401 - 405, and Annex A Training and Certification,
as may be amended from time to time.
C. International Building Code, 2009 edition, Chapters 2 – 29
and 31 – 35, as published in the 2009 International Building
Code, published by the International Code Council, Inc., as may be
amended from time to time.
D. Appendix E of the 2009 International Building Code, as published
in the 2009 International Building Code, published by the International
Code Council, Inc., as may be amended from time to time.
E. Appendix H of the 2009 International Building Code, as published
in the 2009 International Building Code, published by the International
Code Council, Inc., as may be amended from time to time.

As permitted under the terms of § 403.102(l),
Title 34, Labor and Industry, which permits a municipality to enact
an ordinance which meets or exceeds the code in certain designated
sections, the City of Scranton hereby adopts the following amendments
to the codes incorporated above as follows:
A. § 403.42. Permit requirements and
exemptions[(Commercial) from § 403.102(l)(1) above].

The following subsections shall be replaced in their entirety
with the language below:
|
|
(b)
|
Emergency repairs or replacement of equipment
may be made without first applying for a permit if a permit application
is submitted to the Building Code Official within one business day
of the repair or replacement.
|
|
(c)
|
A permit is required for the exceptions listed
in § 403.1(b) (relating to scope) and a permit is required
for the following construction:
|
|
|
(1)
|
Building construction for the following:
|
|
|
|
(i)
|
Fences.
|
|
|
|
(iii)
|
Retaining walls.
|
|
|
|
(iv)
|
Water tanks.
|
|
|
|
(v)
|
Sidewalks and driveways.
|
|
|
|
(ix)
|
Shade-cloth structures constructed for tents,
nursery or agricultural purposes.
|
|
|
|
(xi)
|
Window awnings.
|
|
|
|
(xii)
|
Window replacement with or without structural
change.
|
|
|
(3)
|
The following gas work:
|
|
|
|
(iv)
|
Steam, hot or chilled water piping within any
heating or cooling equipment governed under the Uniform Construction
Code.
|
|
In all other respects, § 403.42 shall remain in full
force and effect.
|
B. § 403.42a. Permit application [from § 403.102(l)(2) above].
|
The following subsections shall be replaced in their entirety
with the language below:
|
|
(b)
|
A permit applicant shall submit an application
to the Building Code Official and attach construction documents, including
plans and specifications, and information concerning special inspection
and structural observation programs, Department of Transportation
highway access permits and any other data required by the Building
Code Official with the permit application. The applicant shall submit
two sets of construction documents with his/her permit application.

(i)
|
A permit applicant shall submit certifications
required in the International Building Code for construction in a
flood hazard area to the Building Code Official and the Zoning Officer.
|
|
In all other respects, § 403.42a. shall remain in
full force and effect.
|
C. § 403.43. Grant, denial and effect
of permits [from § 403.102(l)(3) above].
|
The following subsection shall be replace in its entirety with
the language below:
|
|
(g)
|
A permit becomes invalid unless the authorized
construction work begins within 180 days after the permit's issuance
or if the authorized construction work permit is suspended or abandoned
for 180 days after the work has commenced. A permit holder may submit
a written request for an extension of time to commence construction
for just cause. The Building Code Official may grant extensions of
time to commence construction, which extensions must be in writing
and will be given in writing only. A permit may not be extended beyond
three years from its issue date.

|
In all other respects, § 403.43 shall remain in full
force and effect.
|
D. § 403.62. Permit requirements and
exemptions [(Residential) from § 403.102(l)(8) above].
|
The following subsections shall be replaced in their entirety
with the language below:
|
|
(b)
|
Emergency repairs or replacement of equipment
may be made without first applying for a permit if a permit application
is submitted to the Building Code Official within one business day
of the repair or replacement.
|
|
(c)
|
A permit is required for the exceptions listed
in § 403.1(b) (relating to scope), and the following construction:
|
|
|
(1)
|
The following building construction, replacement
or repairs:
|
|
|
|
(i)
|
Fences.
|
|
|
|
(ii)
|
Retaining walls.
|
|
|
|
(iii)
|
Water tanks.
|
|
|
|
(iv)
|
Sidewalks and driveways.

(viii)
|
Window awnings.

Replacement of existing roofing.
|
|
|
|
(xiii)

Replacement of existing siding.
|

(xiv)
|
Repair or replacement of any part of a porch
or stoop regardless of, whether it structurally supports a roof located
above the porch or stoop.

|
|
(xvii)
|
Installation of any deck, whether covered or
uncovered.
|
|
|
(4)
|
The following mechanical work or equipment:
|
|
|
|
(iv)
|
Steam, hot or chilled water piping within any
heating or cooling equipment governed under the Uniform Construction
Code.
|
|
|
(6)
|
The following heating, ventilation and air-conditioning
work.
|
|
|
|
(i)
|
Replacement of motors, pumps and fans of any
capacity.
|
|
|
|
(ii)
|
Repair and replacement of heating, supply and
return piping and radiation elements.
|
|
|
|
(iii)
|
Replacement of ductwork.
|
|
|
|
(iv)
|
Replacement of air-conditioning equipment and
systems, excluding window units.
|
|
In all other respects, § 403.62 shall remain in full
force and effect.
|
Authority is hereby granted to submit, complete and execute
any and all documents necessary to fully initiate and comply on an
ongoing basis with the Uniform Construction Codes incorporated hereby.
