The following are prohibited acts in the area
of the Nay Aug Gorge, located within Nay Aug Park, a public park of
the City of Scranton:
A. No person shall dive into the Nay Aug Gorge.
B. No person shall, at the Nay Aug Gorge, bathe, swim,
fish or place in the water a boat or raft, excepting emergency personnel
responding to emergency situations.
C. No person shall enter an area at or near the Nay Aug
Gorge which is posted "No Trespassing" or "No Admittance" or "No Admittance
Beyond This Point" when the City of Scranton has posted certain areas
restricting or prohibiting access.
D. No person shall climb in the area known as the "Nay
Aug Gorge," except personnel of the City of Scranton, or emergency
personnel, without the prior written permission of the City of Scranton.
E. No person shall remove, destroy, deface or otherwise
damage any sign, bulletin board or posted list of regulations at or
near the area known as the "Nay Aug Gorge" which has been posted by
the City of Scranton.
F. No person shall refuse or neglect to obey any reasonable
directions of a police officer or any employee of the Department of
Parks and Recreation.
Any person violation any of the provisions of §
332-21 shall be liable, upon conviction, to a fine of not less than one hundred dollars ($100.), plus costs, nor more than three hundred dollars ($300.), plus costs, and, in default of payment, imprisonment not to exceed thirty (30) days for each offense. Each location at which a violation occurs shall be deemed a separate offense. Each entry into the Nay Aug Gorge in violation of §
332-21 shall be deemed a separate offense. Each attempt to dive into the Nay Aug Gorge, or climb onto a ledge or other unauthorized platform for diving shall be deemed a separate offense. The removal, destruction or defacing of each sign shall constitute a separate offense. In addition to the penalties specified in this section, any person convicted of removing, damaging or defacing any sign or signs shall, in addition to the aforesaid penalty, be required to make full restitution for the replacement or repair of any sign or signs, which restitution shall include the cost of mounting or posting the sign in addition to labor and materials.
