The following accumulations are hereby prohibited:
Continued keeping of rubbish, garbage, junk or refuse in or on residential, commercial or industrial property.
The keeping of rubbish or garbage in trucks, trailers or motor vehicles in or on any street, sidewalk or any lands within the City for a period exceeding one hour. Any person violating this Subsection B shall, on conviction, be liable to a fine or penalty of not more than $250 per vehicle.
As used in this article, the following terms shall have the meanings respectively indicated:
Includes dry ashes from coal and other fuels, floor sweepings, bottles, broken glass, broken crockery, oyster or clam shells, tin cans and such mineral substance as may accumulate in connection with the ordinary conduct of households. It does not include the accumulations resulting from the repair of dwellings or other buildings or the result of building operations, tradewastes from stores or manufacturing establishments.
Includes paper, pasteboard, rags, pasteboard cartons when broken, wooden crates or boxes, when broken, and such other burnable refuse as may accumulate in connection with the ordinary conduct of householders.
Includes the refuse of animal or vegetable foodstuffs, kitchen or table waste, vegetables, meat, fish, bones and fat, but does not include oyster or clam shells. Decayed vegetables, fruits or condemned food in the possession of dealers is not considered as "garbage" to be collected by the City.
The Director of the Department of Public Works is hereby given authority to formulate and promulgate, from time to time, such rules, regulations and directions, consistent with the provisions of this article, as he may deem necessary for the proper execution of both the collection and disposal of garbage, ashes and rubbish material.
Each and every owner, tenant, housekeeper and other person occupying any dwelling, house or other building or portion thereof in the City, in which garbage, ashes and rubbish material accumulate and are to be removed therefrom by the City, shall properly provide for such removal by using tight receptacles having a capacity of not fewer than three nor more than 26 gallons. The receptacles shall be provided with a handle or handles and a tight-fitting cover. No person shall use more than one receptacle with a capacity of less than 10 gallons.
All garbage must be drained and wrapped in paper to prevent the same from smelling in hot weather and freezing in cold weather. Paper and other combustible refuse that is not deposited in receptacles must be securely bundled in such a manner as to permit easy handling and to prevent the contents of the same from being scattered.
Garbage and refuse receptacles shall be so placed, by the owner, tenant, housekeeper or other person occupying such dwelling house or other building, in the yard where the same may be easily accessible to the collectors.
All garbage and refuse receptacles shall be kept covered at all times so as to provide sanitary conditions and to prevent rain or snow from entering the same.
No garbage and refuse receptacle shall be filled within one inch of the top thereof. The filled receptacle shall be of such weight as can be easily handled by one man.
Garbage, ashes or rubbish shall not be placed in receptacles which are in a filthy, leaky or defective condition.
