This article shall be known and may be cited
as the "Central Business District Parking Ordinance of the City of
Scranton, Pennsylvania."
The Director of the Department of Public Safety
and other appropriate City officials are hereby authorized to cause
the removal of parking meters within the limits of the Central Business
District as herein defined.
Parking or standing a vehicle within a designated
space within the central business district shall be lawful for a period
of time not to exceed two hours. Parking or standing a vehicle outside
the central business district in a posted area shall be lawful for
a period of time not to exceed two hours.
It shall be unlawful and a violation of the
provisions of this article for any person to cause, allow, permit
or suffer any vehicle registered in the name of or operated by any
such person to be parked beyond the period of legal parking time established
for the Central Business District.

A. No person shall park or leave unattended a vehicle
on private property without the consent of the owner or other person
in control or possession of the property except in the case of emergency
or disablement of the vehicle, in which case the operator shall arrange
for the removal of the vehicle as soon as possible.
B. The provisions of this section shall not apply to
private parking lots, unless such lots are posted to notify the public
of any parking restrictions and the operator of the vehicle violates
such posted restrictions. For the purpose of this section, "private
parking lot" means a parking lot open to the public or used for parking
without charge; or a parking lot used for parking with charge.
C. Penalty. Any person violating any provision of this section is guilty
of a summary offense.

A. Parking enforcement for all parking violations shall be conducted
Monday through Friday of each week between the hours of 8:00 a.m.
and 5:00 p.m.

B. A violation of the two-hour parking limit will be
deemed to have occurred if a motor vehicle bearing a specific registration
plate number is found to be parked in excess of two hours, in the
same space or a space within six spaces in either direction of the
space in which the vehicle was parked at the time the registration
number was recorded.
C. Enforcement shall not be conducted on the following holidays: New
Year's Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving
Day, Christmas Day.

D. The Parking Authority of the City of Scranton, Pennsylvania or its
designee shall be deemed the agent to administer parking permits.
Permits shall not be issued for prohibited zones without written approval
from the Director of Public Safety. Payments for permits shall be
made directly to the Parking Authority of the City of Scranton, Pennsylvania
or its designee.
E. Parking permit program will be as follows:
(1) Construction parking permits. Special all-day parking
permits issued to general contractors for their construction vehicles
will be $20 per day, per parking space. No vehicle citations will
be issued to these vehicles displaying this permit on their dashboard.
This permit will be invalid in prohibited zones without the written
consent of the Director of Public Safety.

(2) Service vehicle parking permits. Special permits will
be issued to companies such as heating and electrical contractors
with service vehicles. The cost of this permit will be $150 per year,
per vehicle. This permit will be invalid in prohibited zones without
the written consent of the Director of Public Safety. This permit
is nontransferable as the license number of each vehicle will be stated
on each permit. This permit shall not be issued to any company, establishment
or corporation within the metered areas of the Central Business District.

(3) Parking permits for volunteer workers. Special permits
will be issued to volunteers of nonprofit organizations such as Meals
on Wheels, the Blind Association, etc. The cost of such permit will
be $10 per year, per vehicle, and will be nontransferable as the license
number of each vehicle will be stated on each permit. This permit
will be invalid in prohibited zones.
(4) Parking permit system for dumpsters. There is hereby
established a parking permit system for dumpsters in the City which
system shall be administered by the Department of Public Safety.
(a)
"Dumpster" shall be defined as a container which
holds garbage, refuse or ashes, which is designed to be emptied by
being raised into the air and turned so that the contents therein
are placed in a garbage truck for disposal, and includes any container
which must be lifted onto the back of a truck to be removed from the
roadway.

(b)
Any person wishing to park a dumpster on any street or highway in the City shall secure a permit from the Department of Public Safety. The permit application shall state: the name and address of the person(s) or corporation applying for the permit, stating with specificity the location desired, describing the precise area where the proposed dumpster will be located, the purpose of placing the dumpster at that location and the anticipated time that such dumpster will be parked. The application shall include a provision that the applicant(s) by his/her(s) signature(s) accepts full responsibility to completely indemnify and hold harmless the City from all damages or injuries of any kind that may occur while the dumpster(s) is parked on a City street or highway; and that the applicant will comply with this Subsection
E(4) and all other rules and regulations concerning the parking of dumpsters. The Director of the Department of Public Safety shall, within a reasonable period of time, verify the location of the dumpster, determine that the proposed placement will not impede traffic and confirm evidence of adequate insurance. A permit fee of $5 per day, per dumpster, must be tendered at the time the permit is issued.
(c)
All dumpsters parked on a City street or highway
must have a flashing light and proper reflectors to provide warning
to approaching traffic, which light and reflective devices shall be
in proper working condition.
(d)
A dumpster may be parked in a right-of-way area on a public street or highway for only one day. Pursuant to a permit issued under this Subsection
E(4), unless the permit holder shall engage an off-duty police officer to ensure the safe movement of traffic around such dumpster.
(e)
The Director of the Department of Public Safety is hereby authorized to promulgate necessary and reasonable rules and regulations concerning the parking of dumpsters by permit, provided that such rules or regulations do not conflict with this section, the home rule charter or state statutes, and such rules and regulations have been approved in accordance with §
6-11C of Chapter
6, Administrative Code.
(f)
Any person who violates any provision of this Subsection
E(4) shall, upon conviction, pay a fine of not less than $100 and a maximum of not more than $300. In default of payment, a person shall be sentenced to imprisonment for a period not to exceed 30 days.
Any person who shall violate or fail to comply
with the provisions of this article shall be subject to a fine of
$10 for violations within the central Business District and $5 for
violations in any posted areas.
