The following words and phrases as used in this chapter shall have the following meanings, unless a different meaning is required by the context:
ARTIFICIAL POOL
Any pool (regardless of design or construction materials and regardless of its permanence or location) built, erected or used for the purpose of swimming or wading.
DISTRICTS
As specified in the Warwick Township Zoning Ordinance, as amended.

PARTLY ARTIFICIAL POOLS
Any pool formed from a natural body of water so limited in flow that the quantity or quality of water must be maintained by artificial means and maintained for the purpose of swimming or wading.
PRIVATE SWIMMING POOLS
Any pool used and maintained for swimming purposes by an individual for use by his household and guests and located on a lot as an accessory use to a residence. Artificial and partly artificial pools, both above and below ground level, having a maximum depth greater than 24 inches shall be included.
PUBLIC SWIMMING POOLS
Any pool used and maintained by an individual, firm, corporation, club or association of persons for use by the public or members and their invitees and guests.
ROAD LINE
The right-of-way line between a lot and a public road, street or highway legally open or officially plotted or between a lot and the edge of the cartway of a private road, street or way over which the owners or tenants of two or more lots held in single and separate ownership have the right-of-way. The "road line" as defined herein shall be considered the boundary of the lot for the purpose of computing the lot area specified in this chapter and without regard to any boundary described in the deed of any lot.
WADING POOL
Any artificial or partially artificial pool installed below ground level having a maximum depth no greater than 24 inches and maintained for wading purposes.

It shall be unlawful to construct or maintain a private swimming pool, wading pool or public swimming pool as herein defined without having obtained a permit therefor in the manner hereinafter described.
Application for a permit for the construction of a swimming pool or wading pool shall be made to the Zoning Officer on such form as may be provided by the Township. Each application shall be accompanied by duplicate sets of plans, specifications and plot plans of the property and a fee paid in accordance with the Warwick Township Fee Schedule. [1] The location of the pool on the property and with respect to adjoining property and road lines shall be shown, together with the location, height and type of fencing or walls and accessory buildings. No permit shall be issued until the plans, specifications and plot plan have been approved by the Building Official and approval has been certified on said plans.

No swimming pool in Warwick Township shall be filled from a public water system under the jurisdiction of the Warwick Township Water and Sewer Authority without written permission of the Authority.

Zoning permits for swimming pools shall hereafter contain the prohibition set forth in § 167-4 above as an addendum under the remarks portion of the permit.

The foregoing restrictions shall not apply to wading pools having a water level of less than 10 inches.
Minimum setback requirements shall be as set forth in Chapter 195, Zoning.

Swimming pools and wading pools shall be constructed and protected in accordance with the pertinent BOCA Codes as adopted by the Township.
All electrical wiring and equipment shall be constructed in accordance with the Electrical Code as adopted by the Township.[1]

No artificial lighting shall be installed, maintained or operated in such a manner as to be a nuisance or annoyance to occupants of neighboring property, as determined by the Zoning Officer.

Any person violating any of the provisions of this chapter shall, upon summary conviction before a District Justice, be sentenced to pay a fine of not less than $300 nor more than $600, plus the costs of prosecution. In default of payment of said fine, said person shall be sentenced to undergo imprisonment in the Bucks County Prison for a period of not more than 30 days. Each day that a violation exists after written notification by the Township shall constitute a separate violation of this chapter.
