A certain document, three copies of which are on file in the office of the Secretary of the Borough of New Hope, being marked and designated as the International Property Maintenance Code, 2003 Edition, as published by the International Code Council, and any amendments thereto or future editions thereof, be and is hereby adopted as the Property Maintenance Code of the Borough of New Hope, Bucks County, Pennsylvania for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for human occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees therefore; and each and all of the regulations, provisions, penalties, conditions, and terms of said Property Maintenance Code on file in the office of the Borough Secretary are hereby referred to, adopted, and made a part hereof, as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed in § 207-2 of this chapter.
The following sections are hereby revised:
A. 
In Section 101.1, insert "the Borough of New Hope."
B. 
In Section 102.3, delete "International Zoning Code" and insert in its place "New Hope Borough Zoning Ordinance."
C. 
Delete Section 103.1 in its entirety.
D. 
Delete Section 103.5 in its entirety and insert the following in its place:
103.5 Fees. The fees for activities and services performed by the code official in carrying out his or her responsibilities under this code shall be established from time to time by resolution of the Borough Council.
E. 
Delete Section 106.3 in its entirety and insert in its place:
106.3 Penalties. Any person who shall violate any provision of this Code shall, upon conviction thereof, be sentenced to pay a fine not to exceed $1,000 and costs, or in default of payment thereof, shall be subject to imprisonment for a term not to exceed 30 days. Each day a violation of this Code continues shall constitute a separate offense. The application of this penalty shall not be held to prevent the enforced removal of prohibited conditions.
F. 
In Section 111, delete Sections 111.2 through and including Section 111.6.2 and insert in their place:
111.2 Appeals Board. The appeals board for all matters and issues relating to the Property Maintenance Code shall be the Borough's Uniform Construction Code Board of Appeals, which was established and is governed by Borough Resolution Nos. 2004-8, 2004-10, 2004-13, 2004-19, and 2004-20R, in compliance with the Pennsylvania Uniform Construction Code Act, as amended, and the rules and regulations of the Pennsylvania Department of Labor and Industry.
G. 
In Section 304.14, insert "April 1 to November 1."
H. 
In Section 602.3, insert "September 15 to April 15."
I. 
In Section 602.4, insert "September 15 to April 15."
All ordinances and parts of ordinances in conflict herewith are hereby repealed, including that part of Ordinance No. 2003-3 which adopted the International Property Maintenance Code, 2000 Edition.
Nothing in this chapter or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any ordinance hereby repealed as cited in § 207-3 of this chapter; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter.
