The provisions of this article shall apply to all premises within the Village of Patchogue except owner-occupied dwelling houses and those to which Chapter
238 of the Village Code is applicable pursuant to the provisions of §
238-1 of said Code. All buildings and structures, including accessory structures, and all parts thereof, shall be maintained in a safe, sanitary and nonhazardous manner. All means of egress, devices, safeguards and equipment shall be kept in good working order. The exterior of all premises and the condition of all buildings, structures and components thereon shall be maintained so as to prevent and repair deterioration, so that the appearance thereof shall reflect the level of maintenance in conformity with the applicable laws of the Village of Patchogue and so as to ensure that the property itself may be preserved safely and that hazards to public health and safety are avoided.
Surface and subsurface water shall be appropriately
drained to protect buildings and structures, to prevent damage to
adjacent property and to prevent the development of stagnant ponds.
Steps, walks, driveways, parking spaces and
appurtenances and other paved areas shall be maintained so as to afford
safe passage for pedestrian traffic and motor vehicle traffic under
normal use and weather conditions. Holes or other hazards shall be
immediately filled or otherwise repaired or replacements be effected.
All off-street parking facilities shall be kept cleanly swept.
All landscaping shall be maintained so that
lawns, hedges, bushes and trees shall be kept trimmed and free from
becoming overgrown and unsightly. When such lawns, hedges, bushes
and trees shall die or otherwise be destroyed, they shall be replaced.
Yards, courts, play areas and vacant lots shall
be kept clean and free of physical hazards. They shall be maintained
in a manner that will prevent rubbish from being blown about the neighborhood.
Open wells, cesspools or cisterns shall be securely closed or barricaded
to prevent access by the public.
All lights, lighting stanchions, utility poles
and other appurtenances shall be suitably maintained in a safe condition
so as to prevent hazards to the public health, safety and welfare.
In the event that the Building and/or Housing
Inspector of the Village of Patchogue shall determine that landscaping
and/or screening conditions on any premises subject to this article
shall be lacking, damaged or otherwise insufficient, the Village Board
shall have the right to direct the appropriate agencies of the Village
to erect, replace, repair or maintain or cause to be erected, replaced,
repaired or maintained, fences, trees, plantings or other landscaping
and/or screening facilities after the owner of the land has been notified
by registered mail at the address shown on the last previous assessment
roll maintained by the Village Receiver of Taxes, of the lack or insufficiency
of or damage to the landscaping and/or screening facilities upon his
land and if such landscaping and/or screening is not repaired, replaced
or otherwise corrected by or on behalf of such owner within 30 days
after receipt of such notice, all costs and expenses incurred by the
Village in performing said work shall be assessed against the land
on which said work shall be required to be done and shall be added
to the tax bill applicable to said property for the next taxable period.
The provisions of this article are not intended
to be exclusive. Any and all other provisions of the Village Code
having applicability to the premises referred to in this article shall
continue to be so applicable. In the event of any inconsistency between
the provisions of this article and the provisions of any other chapter
of the Code of the Village of Patchogue, the provisions of said other
chapter shall apply.

In the event of damage to commercial property
due to fire or other casualty, the owner or other responsible party
shall take the following steps:
A. Within 60 days of said casualty:
(1) Contract for the repair and restoration of damaged
areas intended to be repaired and restored and for the removal of
debris.
(2) Contract for the demolition and removal of any part
of the premises not intended to be repaired and restored and for the
removal of debris in connection therewith.
B. Within 90 days of said casualty:
(1) Repair and restore facades, exterior walls and windows
facing streets and parking areas.

Each owner and occupant shall keep all exterior
components of every building and structure, and all parts thereof,
in good repair, including but not limited to walls, roofs, windows,
doors, porches, steps, landings, chimneys, cornices, gutters, fire
escapes, exterior stairs, shutters, signs, storefronts, marquees and
awnings. Such repair shall include, but not be limited to the following:
A. All surfaces shall be covered with a protective coating,
such as paint, plastic, aluminum or other material which preserves
the structure and does not contribute to deterioration.
B. All surfaces shall be maintained free of deterioration,
including but not limited to broken or missing glass, loose or missing
shingles or siding, crumbling brick, stone and mortar and peeling,
scaling or deteriorated paint.
C. Overhanging structures, including canopies, marquees,
signs, awnings, exterior stairways, fire escapes and other structures
with overhanging extensions shall be maintained in good repair, be
securely anchored to the building or structure and be protected from
rust and other signs of decay by application of a weather protective
material such as paint. Nonoperative or broken electrical signs shall
be repaired or removed. All obsolete signs and sign structures shall
be removed.
D. Cigarette receptacles shall be placed at the entrance of any restaurant
or bar. The receptacle shall not impede pedestrian traffic or hinder
ingress or egress from the entryway. A receptacle must be placed at
any and all entryways utilized by the public. Receptacles shall be
regularly maintained and emptied. The area surrounding the receptacle
shall be kept free and clear of any and all debris.

Any person who violates this article or fails to comply with any of its requirements shall, upon conviction thereof, be subject to the penalties provided in §
1-1 of the Code of the Village of Patchogue.
