A. 
No auctioneer or other person shall by himself, or his agent or agents sell or expose for sale at auction, for himself or for any other person or persons, any goods, wares or merchandise in this City, unless such person be duly licensed as hereinafter provided.
B. 
Every such license, unless issued for a shorter period to be therein specified, shall be granted to expire on the 31st day of January following the date of its issuance.
C. 
The provisions of this section shall not apply to the sale of household furniture, judicial sales or sales by a public officer or by executors or administrators.
Excepting as provided in § 260-3, every person desiring to engage in auctioneering shall on or after the first day of February in each and every year make application to the Clerk/Treasurer for a license. Such application shall state the length of time for which the license is required and shall be signed by the applicant. Such license shall be issued upon the payment to the Clerk/Treasurer of the license fee as set from time to time by resolution of the City Council for either: a per-day fee for a license for a period of one week or less; or a fee for a license for a period ending the 31st day of the following January.

A. 
No licensed auctioneer shall by himself, his agent or agents, sell or expose for sale at auction, any goods, wares, or merchandise on any sidewalk or in any public street or place in the City, excepting that the Department of Public Works with the approval of the City Council may permit the holding of a public sale commonly called a "street auction," such sale to be conducted only upon the streets and under the conditions named in the license permitting the same.
B. 
No more than two such street auctions may be held in the City in any one year. The auctioneers conducting any such street auction shall not be subject to the payment of a license as provided in § 260-1.
Any person or persons to whom a license has been issued as provided by this chapter shall, upon demand, exhibit the same to any police officer or to any City official.
Any person who shall violate any of the provisions of this chapter shall be guilty of a violation, and on conviction thereof shall be punishable by a fine not exceeding $250 or imprisonment in the County Jail of Ontario County for not more than 15 days, or both such fine and imprisonment. Each day on which any such violation continues shall constitute a separate offense.
