This chapter shall be known and may be cited
as the "Water Conservation Law of the Town of New Castle."
As used in this chapter, the following terms
shall have the meanings indicated:
WATER DISTRICT
New Castle Water District No. 1 including its several enlargements,
Stanwood Water District and all areas, whether within or outside of
the Town of New Castle, which are supplied with water by the New Castle
Water District No. 1.
The following uses of water drawn from a pipe
or hose, directly or indirectly connected with a main of said Water
District are prohibited:
A. Operation of a swimming pool with a capacity in excess
of 1,000 gallons without recirculating equipment.
B. Operation of machines or devices using or requiring
a constant water flow.
C. Use or opening of fire hydrants, except for fire-fighting
purposes, except as authorized, in writing, by the Commissioner of
Public Works.
During a first level water emergency, as defined
herein, the following uses of water drawn from a pipe or hose, directly
or indirectly, connected with a main of said Water District are prohibited:
A. Watering of lawns except between 9:00 p.m. and 12:00
midnight and between 5:00 a.m. and 8:00 a.m. or golf courses except
between 12:00 midnight and 8:00 a.m.
B. Washing of any street, sidewalk, areaway, steps, building
or structure.
C. Filling or flooding of skating rinks or skating areas.
D. The serving of water to patrons in restaurants, clubs
or eating places unless specifically requested by the customer.
E. The operation of car washes unless recirculating equipment
is used.
F. Ornamental or display use of public water whether
or not such water is recycled, including fountains, artificial waterfalls,
reflecting pools, lakes and ponds.
During a second level water emergency, as defined
herein, the following uses of water drawn from a pipe or hose, directly
or indirectly, connected with a main of said Water District are prohibited:
A. All uses prohibited during a first level water emergency.
B. Watering or sprinkling lawns, gardens and golf course
fairways.
C. Washing of motor vehicles.
D. Filling of private swimming pools, regardless of size,
except for pools owned by membership clubs or associations or pools
used exclusively for medical treatment.
E. Any other restrictions as may be authorized by resolution
of the Town Board.
Any person committing an offense against any
provision of this chapter shall be guilty of a violation punishable
by a fine not to exceed $250 or by imprisonment for a term not exceeding
15 days, or by both such fine and imprisonment. The continuation of
an offense against this chapter shall constitute, for each day the
offense is continued, a separate and distinct offense hereunder.

During the existence of any emergency affecting
the supply, quality or use of water within the Water District or any
portion thereof such that the public health, safety or welfare may
be adversely affected, the Supervisor of the Town of New Castle or,
in his or her absence, the Commissioner of Public Works may and hereby
is authorized to declare the existence of a first-level water emergency
or second-level water emergency as he or she may deem appropriate
and necessary throughout the Water District or any portion or portions
thereof
The declaration of an emergency
as aforesaid shall be conveyed to the public as soon after declaration
as may be practicable by announcement by one local radio station or
by one daily newspaper of general circulation in the Town of New Castle,
or by both. Additionally, notice may be transmitted to the general
public by distribution of notices, leaflets, handbills or other written
or printed notice distributed to the general public.

An emergency so declared in accordance with
the above shall continue for a period of no greater than 10 days,
unless the emergency is ratified by resolution of the Town Board.

This chapter shall not apply to any items covered
by the Westchester County Water Conservation regulations. Such Westchester
County regulations shall be enforced by the Supervisor of the Town
of New Castle or, in his or her absence, by the Commissioner of Public
Works in accordance with the provisions of those regulations.
