A.
Where any quarry or other excavation in excess of 12 feet in depth at the deepest point is located adjacent to or within 500 feet of a highway, school, church, park, playground or dwelling, or when water in excess of three feet in depth at the deepest point is permitted to accumulate and remain in any quarry or other excavation for a period of 48 hours or more, a protective fence at least six feet in height shall be placed around such portions of the rim of the quarry or excavation as may constitute a hazard to the life or safety of persons; provided, however, that the foregoing provisions and requirements shall not apply to a pond or lake which is an integral part of a recreational facility or exclusively for ornamental purposes. Warnings signs shall likewise be posted.

B.
It shall be the duty of the Board of Commissioners to determine when and where such fences and signs shall be erected and to give written notice to the owner and to the tenant or occupant of any property when and where a fence or sign or signs should be erected, and it shall be the duty of such owner or the tenant or occupant thereof to comply with such notice in accordance with the terms thereof.
