A. Words and phrases. Whenever any words and phrases
are used in this chapter, the meaning respectively ascribed to them
in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall
be deemed to apply to such words and phrases used herein.
B. Official time standard. Whenever certain hours are
named in this chapter, they shall mean either eastern standard time
or eastern daylight savings time as may be in current use.
A. The Township Committee, or the Committee's designee,
is hereby authorized to provide by regulation for the closing of any
street or portion thereof to motor vehicle traffic on any day or days
during specified hours on any day or days whenever it finds that such
closing is necessary for the preservation of the public safety, health
or welfare.
B. Any regulations promulgated by the Township Committee or the Committee's designee and in accordance with Subsection
A above shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
C. Any violation of this regulation promulgated thereunder
shall be punished by a fine not to exceed $50.
D. Any regulation adopted that mandates the closing of
any street for a period greater than 48 consecutive hours shall not
become effective unless and until it has been submitted to and approved
by the Commissioner of the Department of Transportation.
Any vehicle parked in violation of this chapter
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic, and any peace officer may provide for the removal of such
vehicle. The owner shall bear the reasonable costs of such removal
and storage which may result from such removal before regaining possession
of the vehicle.
Unless another penalty is expressly provided
by New Jersey statute, every person convicted of a violation of a
provision of this chapter, or any supplement thereto, shall be liable
to a penalty of not more than $50 or imprisonment for a term not exceeding
15 days, or both.
If any part or parts of this chapter are, for
any reason, held to be invalid, such decision shall not affect the
validity of the remaining portions of this chapter.
All former traffic ordinances of the Township
of Hazlet are hereby repealed, and all ordinances or parts of ordinances
in conflict with or inconsistent with the provisions of this chapter
are hereby repealed, except that this repeal shall not affect or prevent
the prosecution or punishment of any person for any act done or committed
in violation of any ordinance hereby repealed prior to the taking
effect of this chapter.
Regulations not exclusive. The provisions of
this chapter imposing a time limit on parking shall not relieve any
person of the duty to observe other and more restrictive provisions
prohibiting or limiting the stopping, standing or parking of vehicles
as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or
as hereinafter provided.
A. Whenever snow has fallen and the accumulation is such
that it covers the streets or highways, an emergency shall be deemed
to exist and no vehicle shall be parked on any of the streets or highways,
or portions thereof, within the Township of Hazlet.
B. The parking prohibition shall remain in effect after
the snow has ceased and until the streets or highways have been plowed
sufficiently and to the extent that parking will not interfere with
snow plowing or the normal flow of traffic.
C. For violation of any provision of this section, the
maximum penalty, upon conviction, shall be a fine not exceeding $1,000
or imprisonment for a period not exceeding 90 days or a period of
community service for not more than 90 days, or any combination thereof.

A. Traffic controls for street and highway construction and maintenance
operations; adoption of Manual on Uniform Traffic Control Devices
for streets and highways.
(1) The Committee hereby finds and declares that problems of traffic
control occur when traffic must be moved through or around road or
street construction, maintenance operations and utility work, above
or below ground which requires blocking the roadway and obstructing
the normal flow of traffic; and that such obstructions are or can
become dangerous when not properly controlled. In order to better
promote the public health, safety, peace and welfare, it is necessary
to establish controls and regulations directed to the safe and expeditious
movement of traffic through construction and maintenance zones and
to provide safety for the work forces performing these operations.
(2) The Township of Hazlet, in the County of Monmouth, State of New Jersey,
does hereby adopt the current Manual on Uniform Traffic Control Devices,
hereafter known as "MUTCD," except as hereby supplemented and amended,
as it controls and regulates whenever construction, maintenance operations
or utility work obstructs the normal flow of traffic. Any person,
contractor, or utility who fails to comply with the provision of MUTCD
while performing such work is in violation of this section.
B. Preconstruction meetings.
(1) It shall be the responsibility of the person, contractor or in the
case of a public utility wishing to conduct work on, under or above
the roadway, to contact the Superintendent of the Public Works Department
and Hazlet Township Police Department in order to arrange a preconstruction
meeting to submit plans for the safe movement of traffic during such
period of construction or work. The Preconstruction meeting and submittal
of plans shall take place a minimum of five working days' prior to
the requested start of such work. The Chief of Police, or his designee,
shall have discretion for the scheduling of such meeting if requested
within five working days to the requested start of such work or during
emergency situations. Prior to the start of construction operations,
the contractor shall assign a supervisory-level employee to serve
as the Traffic Control Coordinator. The Hazlet Township Police Department
shall be notified as to the name of this individual, along with a
method of contacting the individual on a twenty-four-hour, seven-day-a-week
basis, before or at the preconstruction meeting. Any person, contractor
or utility who fails to comply with this section prior to the start
of such work or whose plans are not approved by the Traffic Bureau
of the Hazlet Police Department is in violation of this section.
(2) Public utilities conducting routine maintenance work need not comply
with the preconstruction meeting requirement.
C. Emergency contact telephone numbers.
(1) The person, contractor or utility shall provide the Traffic Bureau
with at least two emergency phone numbers to be called in case of
emergency problems or hazardous conditions at the construction or
maintenance site prior to the start of any work. If for any reason
emergency contacts cannot be reached or if the emergency contact person
does not respond to a call from the Police Department to correct a
hazardous condition, the Township may respond to correct such hazardous
condition. The reasonable fees for such emergency services by the
Township shall be charged to the person, contractor or utility responsible
for such condition.
D. Hours.
(1) There shall be no construction, maintenance operations or utility
work on any roadway in the Township before the hour of 7:00 a.m. or
after 4:00 p.m. This time limit may be adjusted to permit work prior
to 7:00 a.m. or after 4:00 p.m. by the officer in charge of the Hazlet
Township Police Department. If it is determined by the officer in
charge that the construction or maintenance operations prior to 7:00
a.m. or after 4:00 p.m. would substantially delay traffic or cause
a safety or health hazard, the work shall then be permitted only between
7:00 a.m. to 4:00 p.m. Approval to work outside of the Township permitted
work hours must be given prior to scheduling and/or start of the construction,
maintenance operations or utility work.
E. Road closings and detours.
(1) The Hazlet Township Police Department and/or the Township Engineer
is hereby authorized to provide by regulation for the establishment
of a work zone, including but not limited to the detour and/or closing
of any street or portion thereof to motor vehicle traffic, whenever
they find that such closing is necessary for the preservation of public
safety, health or welfare.
(2) All street closings shall be discontinued and the area under construction
reopened to traffic at the conclusion of a work day until work begins
the following work day. This shall include the contractor ensuring
that all of his or her equipment and materials are removed from the
roadway, the road clear of debris and all raised manholes, inlets,
and other appurtenances have traffic control devices (i.e., drums)
placed over them. In the event that the manhole, inlet or other appurtenance
is in the middle of a travel way and the placement of a traffic device
would impede the flow of traffic, the manhole, inlet or other appurtenance
shall be ramped with fresh bituminous material (either cold or hot
mix), and the use of millings to perform this operation shall not
be permitted.
(3) The foregoing provisions shall not apply to a contractor that obtains
approval to maintain a street closing on a twenty-four-hour basis,
which shall be subject to regulations set forth by the Hazlet Township
Police Department and/or Township Engineer.
(4) The Township shall not be liable for any actions or omissions by
a contractor relating to performance of requirements set forth under
this section, and the Township shall retain all immunities it possesses
under all applicable laws, including but not limited to the New Jersey
Tort Claims Act, N.J.S.A. 59:1-1 et seq.
F. Traffic directors.
(1) Traffic directors shall be posted at all construction or maintenance
sites when determined by the Hazlet Township Committee or its designee
that same is necessary to provide for the safety and expeditious movement
of traffic.
G. Stop work.
(1) The Hazlet Township Committee or its designee shall have the authority
to stop work, including the removal of equipment and vehicles, stored
material within the street right-of-way, backfilling of open excavations
and/or other related work in order to abate any nuisance, traffic
delay and/or safety hazard or for any violation of this section.
H. Site preparation.
(1) It is to be expressly understood that no materials, vehicles or equipment
are to be placed in the roadway or sidewalk until all construction
signs, light devices and pavement markings are installed.
(2) The contractor shall be responsible for maintaining driveway access
for all adjacent property owners. In the event that driveway access
must be temporarily denied, the contractor shall provide written notice
to the Hazlet Township Police Department and affected property owner(s)
at least five working days in advance of the driveway closing.
(3) The contractor shall present to the Hazlet Township Police Department's
Traffic Safety Unit all traffic control devices and materials necessary
to execute proper maintenance and protection of traffic operations
for the project, as well as the number and type of traffic control
devices deemed necessary by the Hazlet Township Police Department's
Traffic Safety Unit. The contractor shall have all traffic control
devices and materials present for examination at least five working
days' prior to the start of work.
(4) All traffic control devices supplied are to be new or in satisfactory
condition. Traffic control devices damaged under the work contract
as a result of carelessness or mishandling by the contractor (i.e.,
running over cones or barrels with his equipment or splashing tar
on traffic control devices, etc.) shall be replaced by the contractor
within five working days.
(5) The Hazlet Township Police Department's Traffic Safety Unit reserves
the right to reject any traffic control device which, in its sole
discretion, does not satisfy the criteria of M.U.T.C.D. specifications,
is damaged, or is otherwise incapable of providing the function for
which it was intended. In such case, the contractor shall replace
the deficient traffic control devices and/or materials within two
working days.
(6) If the contractor completes work pursuant to a public contract with
the Township of Hazlet, and the contract provides for the Township
gaining possession of traffic control devices, all traffic control
devices and materials used therein shall become the property of the
Township at the conclusion of the contract term.
I. Emergency repair work.
(1) In the case of emergency repair work where construction maintenance
operations or emergency utility work must be performed that will obstruct,
interfere or detour traffic on any roadway in the Township, the person,
contractor or utility performing such operation shall notify the Police
Department of such emergency operation. The person, contractor or
utility shall disclose the nature of the emergency, location and hours
of operation.
(2) All emergency construction and maintenance operations shall be performed
with full regard to safety and to keep traffic interference to an
absolute minimum. During such emergency repair work, the person, contractor
or utility shall comply with the provisions of the MUTCD while performing
such emergency repair work.
J. Traffic control coordinators.
(1) Traffic control coordinators shall be certified by the American Traffic
Safety Services Association (ATSSA) or equivalent. Certification shall
be provided to the Hazlet Township Police Department prior to start
of any construction when working at a construction or utility site.
Township Police, or their designee, shall be posted at all construction
or maintenance sites on Township roadways when determined by the Hazlet
Township Police Department that it is necessary to provide for the
safety and expeditious movement of traffic. All costs connected with
such traffic controls shall be at the cost of the applicant/independent
contractor.
K. Violations and penalties.
(1) Any person, contractor or utility who commits a violation of this
section shall, upon conviction thereof for a first offense pay a fine
of not less than $100 nor more than $500 and/or be imprisoned in the
County jail for a term not exceeding 90 days. For a second offense,
upon conviction thereof, pay a fine of not less than $250 and/or be
imprisoned in the County jail for a term not exceeding 90 days. For
a third or subsequent conviction, pay a fine of not less than $500
and/or be imprisoned in the County jail for a term not exceeding 90
days.
(2) A separate offense shall be deemed committed on each day during or
on which a violation occurs or continues.

C. Handicapped parking on private property open to the
public and to which the public is invited (retail business).
(1) In accordance with the provisions of N.J.S.A. 40:48-2.46,
the following street parking yards are designated as handicapped parking
areas. Such spaces are for use by persons who have been issued special
identification cards, plates or placards by the Division of Motor
Vehicles or a temporary placard issued by the Chief of Police. No
other person shall be permitted to park in these spaces.

(2) No person shall park in any space on public or private
property appropriately marked for vehicles for the physically handicapped
pursuant to P.L. 1977, c. 202 (N.J.S.A. 39:4-197.5), P.L. 1975 c.
217 (N.J.S.A. 52:27D-119 et seq.) or any other applicable law unless
the vehicle is authorized by law to be parked therein and a handicapped
person is either the driver or a passenger in that vehicle. State,
county or municipal law enforcement officers or parking enforcement
officers shall enforce the parking restrictions on spaces appropriately
marked for vehicles for the physically handicapped on both public
and private property.
(3) No person shall move a vehicle not lawfully under
his control into any such prohibited area or away from a curb such
distance as is unlawful.
(4) Pursuant to P.L. 1989, c. 201, the penalties for violations
must be $100 for a first offense and for a subsequent offense must
be a fine of at least $100 and up to 90 days community service on
such terms and such form as the court shall deem appropriate, or any
combination thereof.
D. Handicapped parking on all other private property.
In accordance with the provisions of N.J.S.A. 39:5A-1, the following
off-street parking locations are designated as handicapped parking.
Such spaces are for use by persons who have been issued special identification
cards, plates or placards by the Division of Motor Vehicles or a temporary

E. Signs and pavement markings, installation and maintenance. The owners of the premises referred to in Subsections
C and
D shall provide and install signs and pavement markings for each parking space reserved for the use of handicapped persons, which signs and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of said property. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township of Hazlet. The owner shall be responsible for the repair and restoration or replacement of same.
A. Regulation for the movement and the parking of traffic
on Municipal Property and Board of Education Property. In accordance
with the provisions of N.J.S.A. 39:4-197, the following municipal
and Board of Education property shall have the movement of traffic
controlled by the type of regulation indicated. No person shall operate
or park a vehicle in violation of the regulations indicated.

(2) Hazlet Township parking lot.
(a)
Creation. There is hereby created a municipal
parking lot, to be known as the "Hazlet Township parking lot," on
premises owned by the Township and described as follows:

Beginning at a point 25 feet west of the northerly
side of the railroad right-of-way and the center line of Hazlet Avenue,
and thence westerly along the northerly railroad right-of-way line
a distance of approximately 442 feet to a point, thence northerly
a distance of approximately 184 feet to an existing woven wire fence,
thence easterly a distance of approximately 442 feet to a point in
the westerly side of Hazlet Avenue, thence southerly a distance of
approximately 184 feet along the westerly side of Hazlet Avenue to
the point and place of beginning.

(b)
Use. The intended use of the Hazlet Township
parking lot is to provide for commuter parking during certain prescribed
times and, at all other times, to provide parking for the general
public attending recreational activities held on Township-owned or
leased property in the immediate vicinity of the Hazlet Township parking
lot.
(c)
Permit parking. Every vehicle parked in the
Hazlet Township parking lot shall display a parking permit identification
placard on the rear view mirror.

Applications for parking permits and parking
permit identification placards shall be obtained from the Hazlet Township
Department of Public Works, 39 Leocadia Court, Hazlet, New Jersey
07730, on a form and with such information as shall be determined
by said Department.

Parking permits and parking permit identification
placards shall be issued for a period of one year for the sum of $60
which shall be submitted in the form of a check, money order or cash
with the application. Identification placards shall be issued effective
November 1 of each year and shall expire on October 31 of the immediately
succeeding year; provided, however, that parking permits and parking
permit identification placards issued on or after May 1 of any year
shall be issued for a term expiring on October 31 of the year of issue
and the charge for such parking permits and parking permit identification
placards shall be $30 each.

The fee charged for parking permits and parking
permit identification placards shall be nonrefundable. A parking permit
and parking permit identification placard shall not be assigned, transferred
or used for any vehicle other than the vehicle for which the same
shall have been issued.

Applications for parking permits and parking
permit identification placards shall be accepted and the same shall
be issued by the Hazlet Township Department of Public Works as follows:
[a] Applications shall be accepted
from the permits and identification placards issued to any present
parking permit holder during the period July 1 through July 31 of
the year immediately preceding the year for which such permits and
identification placards shall be issued and effective.
[b] Applications shall be accepted
from and permits and identifications placards issued to any resident
of the Township of Hazlet during the period August 1 through August
31 of the year immediately preceding the year for which such permits
and identification placards shall be issued and effective.
[c] Applications shall be accepted
from and permits and identification placards issued to any other applicant
during the period September 1 through September 30 of the year immediately
preceding the year for which such permits and identification placards
shall be issued and effective.

Parking permits and parking permit identification
placards shall be issued in the order set forth above until all available
parking permits and parking permit identification placards shall have
been issued. If an application from a member of the class defined
in Subsection A(2)(e)[1][a] and [b] above is received after the expiration
of the application period provided for such class, such late application
shall be accepted and a parking permit and parking permit identification
placard shall be issued in accordance with the provisions pertaining
to the next applicable lower class.
(f)
Unlawful parking. It shall be unlawful to park
any vehicle in the Hazlet Township parking lot without displaying
a parking permit identification placard on the rear view mirror. It
shall be unlawful to park any vehicle in any area of the Hazlet Township
parking lot other than within those areas designated by painted lines
as stalls for parking purposes.

(g)
Speeding. The maximum speed limit for all traffic
moving in any direction in or on the Hazlet Township parking lot shall
be 15 miles per hour.

B. Regulation for the movement and the parking of traffic
on private property open to the public and to which the public is
invited (retail business). In accordance with the provisions of N.J.S.A.
40:48-2.46, for the following private property that is open to the
public and to which the public is invited the movement of traffic
shall be controlled by the types of regulations indicated. No person
shall operate or park a vehicle in violation of the following regulations:

C. Regulation for the movement and the parking of traffic
on all other private property. In accordance with the provisions of
N.J.S.A. 39:5A-1, the regulations of Subtitle 1 of the Title 39 are
hereby made applicable to the properties listed below.
(1) Shore Haven Mobile Home Parks. Oakview Development
Corporation has filed a written consent with the Township of Hazlet
that the provisions of Subtitle 1, Title 39, of the Revised Statutes
of New Jersey be made applicable to the semipublic roads, streets,
driveways and parking lots at The Shore Haven Mobile Home Park located
in the Township of Hazlet, County of Monmouth, and the following regulations
shall be enforceable.

lots at Fieldcrest at Hazlet located in the Township of Hazlet, County
of Monmouth, and the following regulations shall be enforceable.

or exitways, loading zones, oil fills, any grass area or pedestrian
walkway or present in any way a safety or traffic hazard may be removed

streets, driveways and parking lots at the Wellington Square located
in the Township of Hazlet, County of Monmouth, and the following regulations
shall be enforceable.

(6) Hazlet Residential Development, LLC, the developer of a residential
development known as The Landing, located on Block 68.13, Lot 26,
at the intersection of Route 36 southbound and Aumack Lane (and formerly
the Holy Family School) has filed a written consent with the Township
of Hazlet that the provisions of Subtitle One of Title 39 of the revised
statutes of New Jersey be made applicable to the driveways and parking
lots on its property located in the Township of Hazlet, County of
Monmouth, and the following regulations shall also be enforceable:

(a)
Turn prohibition on exit driveway onto Aumack Lane, left turn

D. Signs and pavement markings, installation and maintenance. The owners of the premises referred to in Subsections
B and
C shall provide and install signs and pavement markings for each parking space reserved for the use of handicapped persons, which signs and markings shall be in accordance with the manual on Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of said property. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township of Hazlet. The owner shall be responsible for the repair and restoration or replacement of same.

A. Permit required. No motor vehicle shall be parked
on the street or parts of streets designated in Chapter 305-39 on
a daily basis during the hours designated in the said schedule unless:
(1) The
motor vehicle is owned or operated on a regular basis by a resident
of the street;
(2) The motor vehicle has displayed on its left rear window
in such a manner as to be closely examined by a police officer a current
residential parking permit. Visitor permits shall be hung from the
rear view mirror or placed on the dashboard of the visitor's vehicle;
and
(3) The motor vehicle falls under one of the exceptions
to the parking ban.
B. Exemptions.
The following motor vehicles shall be exempt from the permit parking:
(1) Visitors. A vehicle displaying a current visitor parking
permit may park a maximum of two days, provided that the operator
of the motor vehicle is a bona fide guest of a resident within the
permit parking area. The visitor's permit shall be displayed on the
rear (window) view mirror or the dashboard of the vehicle in such
a manner as to be clearly visible by a police officer enforcing the
parking regulations.
(2) Contractors, service and delivery vehicles. Contractors,
service and delivery vehicles bearing the name and address of a commercial
business may park without a permit during the time they are rendering
the service to the residents within the permit parking area.
(3) Emergency vehicles. Emergency vehicles and public
service telephone and other public utility motor vehicles may park
within the permit parking area during the time they are rendering
services or repairs within the area.
C. Applications.
(1) Applications for parking permits under this chapter
shall be made in writing on forms provided by the Hazlet Township
Police Department Traffic Safety Division. Permits shall be granted
only under the following terms and conditions:
(a)
To persons who are residents on said street
or any portion thereof upon which parking is restricted by this chapter,
a permanent permit, valid for one year, shall be issued for every
vehicle owned or principally operated by such person; and
(b)
Two visitor permits shall be issued to each
residential unit on any street or portion thereof upon which parking
is restricted by this chapter for use only by visitors to that residential
unit.
(2) The application shall consist of the following:
(a)
The application will contain a paragraph stating
that the permits will be revoked for misrepresentation, misuse or
abuse;
(b)
The application will be signed by the person
applying for the permit;
(d)
The name of the applicant;
(e)
The address of the applicant;
(f)
The telephone number of the applicant; and
(g)
A valid registration and plate number for each
residential parking permit issued will be necessary, visitor permits
excluded.
D. Violations
and penalties. Any person who violates any provisions of this chapter
shall, upon conviction thereof in the Township of Hazlet Joint Municipal
Court, be punished by a fine not exceeding $100. A separate offense
shall be deemed committed on each day during or on which a new violation
occurs or continues.

E. Schedule I: Parking by permit only. In accordance with Subsection
A, no motor vehicle shall be parked on the following streets between the hours of 5:00 a.m. and 4:00 p.m., Monday through Friday.

Unless authorized by a sworn law enforcement officer, no person
shall operate, park, leave or be in possession of a motor vehicle
which is unregistered or has a suspended registration in any parking
yards (lots) and parking places, which are open to the public or to
which the public is invited, whether owned or maintained by a governmental
entity or in conjunction with any business or enterprise, whether
public, quasi-public or private.
A. Exemptions. This section shall not apply to:
(1) Private property to which the public is not invited, such as residential
lots.
(2) Motor vehicles which are exempt from registration under Title 39
of the New Jersey Statutes, such as car dealer inventory.
B. Removal. Any police officer is authorized to order the removal of
any unregistered vehicle in violation of this section to a storage
space or garage, and the expense involved in such a removal and storage
of the vehicle shall be borne by the owner of the vehicle, except
that the expense shall be borne by the lessee of a leased vehicle.
C. Penalty. The violation of this section shall subject the person so
convicted or pleading guilty to a fine of $100 for an unregistered
vehicle and $175 for a vehicle which has a suspended registration.

No person shall at any time use any automobile, truck or other
motor vehicle, located on any public or private highway, road or street,
or any public or private lot or premises in the Township for sleeping
or living purposes.
A. Violations and penalties.
(1) Any person who commits a violation of this section shall, upon conviction
thereof for a first offense pay a fine of not less than $100 nor more
than $500 and/or be imprisoned in the County jail for a term not exceeding
90 days. Any person who is convicted of violating this ordinance within
one year of a previous violation shall pay an additional fine of not
less than $250, nor more than $500, as a repeat offender. This additional
fine for a repeated offense shall be calculated separately from the
fine imposed for the violation of the ordinance.
(2) A separate offense shall be deemed committed on each twenty-four-hour
calendar day during or in which a violation occurs or continues.
