In accordance with the authority conferred upon the Borough by N.J.S.A. 4:19-15.12, the sum to be paid annually for a dog license in the Borough and each renewal thereof shall be, beginning January 1, 1988, as provided in Chapter 275, Fees. In addition to the license fee, there shall be a penalty for late registration, which penalty is set forth in Chapter 275, Fees.
All dog licenses issued under the authority of N.J.S.A. 4:19-15.1 et seq. shall be so issued by the Tax Collector of the Borough or his/her designee.

A. 
No person shall permit any dog in his/her care or under his/her care, whether on a standard, wireless, or electronic leash, to run at large upon public streets, in any public park, in any public building, or in any public place within the Borough, nor go upon the lawn, yard, entrance walk, or driveway of any private residence without the permission of the owner thereof. There shall be the presumption that any dog found running at large shall have been permitted to run loose by the person owning, keeping or harboring said dog. Whenever a potentially dangerous dog is off the property of the dog’s owner, the dog must be on a leash or controlled with another appropriate restraint. If the owner does not comply, the owner will be subject to a fine of $250 for the first violation, $500 for the second violation, and $750 for the third and subsequent violations.
B. 
If a dog attacks a person, the municipal court shall declare the dog to be potentially dangerous, if it finds evidence that the dog caused bodily injury to a person during an unprovoked attack, and poses a serious threat of bodily injury or death to a person. The owner of the dog will be ordered to immediately erect and maintain an enclosure for the potentially dangerous dog on the property where the potentially dangerous dog will be kept, which has sound sides, top and bottom to prevent the potentially dangerous dog from escaping by climbing, jumping, or digging within a fence at least six feet in height. The owner of the potentially dangerous dog shall securely lock the enclosure to prevent the entry of the general public and to preclude any release or escape of the potentially dangerous dog. If the owner does not comply, the owner will be subject to a fine of not less than $250 nor more than $750 per day of the violation, and each day of the continuance of the violation will constitute a separate and distinct violation.
C. 
In the event that a dog, whose owner resides within the Borough of North Haledon, is found to be a potentially dangerous dog pursuant to N.J.S.A. 4:19-23, the dog shall be issued a vicious dog license from the Tax Collector’s Office.

An Animal Control Officer shall take into custody and impound or cause to be taken into custody and impounded the following:
A. 
Any potentially dangerous dog off the premises of the owner or of the person keeping or harboring said dog.
B. 
Any dog off the premises of the owner or of the person keeping or harboring said dog without a proper license.
C. 
Any dog running at large in violation of § 202-3.
D. 
Any dog which has bitten or injured a person unless said person was committing or attempting to commit a crime or offense upon the owner of person with custody or control of the dog or committing or attempting to commit a trespass or other criminal offense on the property of the owner or person with custody or control of the dog, or if said person was abusing, assaulting, or physically threatening the dog or the dog’s offspring.
E. 
Rabid dogs.
F. 
Animals that are ill, injured or pose a threat to the public.
No person shall keep, harbor or maintain any dog which habitually barks or cries as defined in Chapter 406, Noise.

No persons, firm, association or corporation shall keep, harbor or maintain more than four dogs of licensing age at any premises within the Borough of North Haledon.[1]

Any dog which is vicious or appears to be suffering from rabies or affected with hydrophobia, mange or other infectious or dangerous disease and found running at large may be forthwith destroyed by any police officer or the Animal Control Officer. A report of all dogs shall be promptly filed with the Chief of Police, who shall keep a proper and complete record in a substantially bound book.

Any person who violates or who fails or refuses to comply with these dog regulations shall be punishable as provided in Chapter 1, General Provisions, Article II, General Penalty.

As used in this article, the following terms shall have the meanings indicated:
AT LARGE
Off the premises of the owner and not under the control of the owner, agent or a member of his/her immediate family, either by leash, cord, chain or otherwise.
DOG
Any dog, bitch or spayed bitch.
DOG OF LICENSING AGE
Any dog which has attained the age of seven months or which possesses a set of permanent teeth.
OWNER
When applied to the proprietorship of a dog, includes every person having a right of property in such dog or every person who has such dog in his/her keeping.

POUND
An establishment for the confinement of dogs seized either under the provisions of this article or otherwise.
It shall be the duty of any person having knowledge of any dog, cat or other animal within the Borough having bitten any person, being infected with rabies, or suspected of being infected with rabies, to forthwith notify the Board of Health and, if possible, to give a description of the animal, the location where it may be found and the name and address of the owner or the person having custody thereof.
Whenever any dog, cat or other animal owned, possessed, harbored or in the custody of any person resident in the Borough shall bite any person or be suspected of being infected with rabies, it shall be securely confined in the residence of such person or the residence of one of them or in the establishment of a duly licensed veterinarian of the State of New Jersey at least 10 days and until such time as, without cost to the Borough, a certificate is filed with the Board of Health of the Borough, signed by a duly licensed veterinarian of the State of New Jersey, certifying that such dog, cat or other animal is not rabid.
