As used in this chapter, the following terms shall have the meanings indicated:
COMMERCIAL LANDSCAPER
A person or entity whose business involves the placing, planting, arranging, trimming, cutting, removing of trees or maintenance of lawns, trees, bushes, shrubs, gardens and related appurtenances on land or property for the purpose of improving or maintaining same.
VEHICLE
Every device in, upon or by which a person or property is or may be transported upon a highway.
The application for permit to operate or conduct business as a commercial landscaper in the Borough of North Haledon shall be made in writing to the Municipal Clerk and signed by the applicant. The application shall set forth:
A. 
The name, address and telephone number of the applicant.
B. 
The character and type of substance (e.g., grass clippings, brush, twigs, leaves) that the applicant will be dumping in his/her operation.
C. 
The location where the debris is to be taken and the name and telephone number of the company/organization to receive said debris.
D. 
The name and address of the applicant's provider of general liability insurance, and the applicant shall attach to its application proof of general liability insurance.
Every commercial landscaper operating within the Borough of North Haledon shall be required to comply with the following:
A. 
The name of the landscaping company shall be clearly indicated on both sides of any vehicle used in said operation, shall be no less than three inches in height, and shall include the name, address and telephone number.
B. 
An annual fee as set forth in Chapter 275, Fees, shall be paid to the Borough by each commercial landscaper.
C. 
Tags identifying that vehicles have been properly registered must be displayed on each vehicle.
D. 
Registration shall be renewed no later than March 31 of each year.
E. 
Notwithstanding the foregoing, a commercial landscaper providing proof of registration with the State of New Jersey, Department of Consumer Affairs, as a registered contractor shall be exempt from the payment of the permit fee hereunder upon presentation of the original registration certificate.
F. 
No landscaping company shall be authorized to register more than five vehicles.
Any person or persons who shall violate or fail to comply with any of the provisions of this chapter, upon conviction thereof, shall be punished by a fine of not less than $100 for the first offense, not less than $100 and not to exceed $500 for the second offense and not less than $100 and not to exceed $1,000 for the third offense and/or the revocation of the permit to further operate within the Borough.
