No person or persons shall, in the Borough of
Prospect Park, in a blasting operation, use a quantity of explosives
greater than necessary to properly start or loosen the rock from its
original position.
No person or persons shall fire or cause to
be fired a blast in rock in the Borough of Prospect Park until all
exposed sides of said rock shall have been covered with a strongly
woven matting rope or wire of at least 1 1/2 inches in diameter,
covered with sufficient timbers to hold said matting in place during
the blast. Said timbers shall be at least 10 feet long and 10 inches
in smallest diameter, held securely together by chains or by wire
or steel cables at least 3/4 of an inch in diameter, except that where
the rock to be blasted is, in its original position, on the perpendicular
or diagonal face or side of a breast or ridge of rock, then a sufficient
protective covering shall be placed over the blast to prevent pieces
of rock or debris flying upward or outward.
No person or persons shall explode a blasting
charge in the Borough of Prospect Park unless at least three minutes
before firing the blast the blaster shall give warning thereof by
causing a competent man carrying a red flag to be stationed at a reasonable
distance from the blast at each avenue of approach or point of danger.
No person or persons shall conduct a blasting
operation in the Borough of Prospect Park between the hours of 7:00
p.m. and 7:00 a.m. nor at any time on Sunday without having first
obtained a special permit therefor from the Council of the Borough
of Prospect Park.
Each and every person violating any of the provisions
of this chapter shall, upon a conviction thereof, forfeit and pay
a fine of not more than $200, and, in default of the payment of such
fine, the Judge before whom any such person or persons may be brought
may commit the defendant to the County Jail for any term not exceeding
90 days.
